What if both I-129F and I-130 have been approved

Hi all,

My wife is scheduled to have her interview for K-3 Visa 20th of this month. I just got an email notification that my I-130 petition has been approved as well (I'm out of town, travelling for work these days so have not gone back home to receive the paper approval notice yet).

My question is, what should we do? Should we go ahead with the k3 visa interview appointment or need to do something different now that I-130 has been approved as well? Does it matter either way?

Any help would be greatly appreciated! Thanks.

Timeline

If the CR1 is at the embassy at the time of your interivew you can ask them to change the interview from K3 to CR1.

Otherwise, go for the K3 and adjust status stateside or go back and reinterivew at time of CR1 in Pakistan.

I'm in the same boat, except the K3 has just been sent to the Consulate (London)!

09/18/2006: NVC Case # assigned

09/25/2006: I864 and IV Fee Bills received (arrived jointly – using IL)

10/05/2006: Mailed both fee bill (confused what to do! K3 or I130 – finally decided to let both ride)

11/05/2006: Mailed back both I864 and DS230

01/29/2007: CR1 forwarded to London Consulate

03/01/2007: Packet 4 recieved

03/26/2007: CR1 Interview in London

I-129F (K-3)

06/19/2006: I-129F application Sent (Old, non-IMBRA)

06/26/2006: NOA1 received

07/17/2006: RFE (IMBRA) received

07/20/2006: RFE (IMBRA) replied

07/24/2006: Confirmation RFE reply received (July 24th)

09/15/2006: APPROVED (81 days)

09/18/2006: NOA2 received

09/26/2006: NVC received petition & assigned Case #

09/28/2006: Conf Letter received – Case # and ‘Case to be sent to be sent to London’ “within a week”.

10/03/2006: [ESTIMATE] – Case received at London Visa Unit.

xx/xx/xxxx: Packet 3 was never recieved

10/21/2006: Packet 3 (compiled by us) sent

11/09/2006: Medical Date

11/09/2006: Packet 4 received.

12/11/2006: Interview - Approved !!

12/21/2006: USA!!!

Basically, once you receive the K3 from the consulate, your spouse can come to the U.S. THEN the option is to A return to their country when the I-130 appointment is made at the consulate OR B apply for AOS in the U.S.

If you can afford it, it will likely be fastest to return for the I-130 rather than apply for AOS. That is what my husband will do if we are fortunate enough to get the K3 approved quickly.

NOA1: 5-10-2006----updated w/ citizenship: 9-25-06----had to call back 10/25, touch 10/26

12/06/06 - Approved!- - - 12/08/06 - Touch---01/25/07 - Touch

I130 at NVC

12/14/06 - case number assigned

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

it mentions filling for I-130 and I-485. My question is:

- Since I already applied for I-130, based on which I then applied for I-129F and she got the k-3 visa, I DO NOT need to apply I-130 again, Correct? I should simply file for I-485 at this point, right?

You don't have to apply for the I-130 again. You will need to send a copy of the I-130 NOA2 approval you received in October along with your AOS applications.
