My husband of 5 yrs just filed I-130 for myself who came here legally but went on out of status and for my child who lives in the Philippines on 2/11/2012. I received a noticed of reciept 797-C for my child overseas. But where is mine?

Does anyone have the same situation like I do?

Please let me know.

Moved from IR-1/CR-1 Process & Procedures to Adjustment of Status from Work, Student, & Tourist Visas. OP has indicated they are already in the US and have filed to adjust status.

OP, when your husband filed the I-130 on your behalf, did he also file the I-485? If he only filed the I-130 and you return to the Philippines for an interview, you may have incurred a ban and would require a waiver to reenter the US; that depends how long you have been out of status (length of overstay).

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

Hi Ryan, thanks for responding. Yes, my husband filed I-130 with I-485 & I-765 for me and my minor child who lives in the Philippines. I am currently residing here in the US with my husband and 2 children. We sent the packet of 2 - I-130 for me and my minor child (currently in the Philippines) on 2/11/12 to Chicago Lockbox.

2/14/12 - packet was recieved

2/22/12 - I-130 for my minor child was forwarded to Laguna Niguel, California processing

2/27/12 - Received hard copy of NOA1 for my minor child I-130

Why I have not receieved my NOA1 since it was mailed to Chicago Lockbox in the same packet? How long it will take for me to receieved my NOA1?

Please help.
