I just need a super clear answer of if this is going to work and there wont be any penalties going this route.

We are engaged, wanting to get married. We were going to go the Fiancee visa route until I realized the CR1 is the better option.

I have been told that my UK Fiancee can enter US [Texas] under the visa waiver program and us have a wedding and get married... then him leave back to the UK, and then me file a CR1.

Is this for real or is this too good to be true.

That's basically what we did. My husband came to the US for a week visit, we got married during that week, and he has been back in Canada since the marriage (with the exception of some more short visits). We filed for a CR-1 visa, and we're just two weeks away from our interview! It's totally above board.

The only thing is that the border guards need to be confident that your fiance is going to go back: bring evidence of continued employment (letter from employer with an expected return date) and continued residence in the UK (lease, bills, etc.)

Yes as long as he leaves after the wedding and you file for a spousal petition this is fine.
