AOS Question

Hello,

I have a question to ask. My husband and I have been married for almost 3months. And we are doing this adjustment of status. I am trying not to have a headache. When he was studying ESL in Ohio long before we met, he encounter a crazy lady. She lied on him, and got him arrested. Long story short, it turned out to be a lie, they went to court, the case was dismissed, and his lawyer counter-sued her on damaging of character and reporting false charges, etc.

He was cleared, however on the G-325B it's asking for any type of arrest and all. Which of course we put that down. However, he's very nervous. Should we be concerned even though the case was dismissed and thrown out of court, and the girl later was charged for purgery.

Worried Saudiwife.

If you said it turned out to be a lie and they just went to court to clear things out, I don't think they count that as an arrest. Just my thought.

If it was a lie and was dismissed it shouldn't be a problem. My husband was charged with a felony (total mistake) and the case was dismissed/charges were dropped as soon as it went to court because it was, well, a total mistake. He had to show the dismissal papers but it posed NO problem for AOS.

You still have to mark it YES to that answer and include copy of court outcome (dismissal) with the package.

As mentioned, just be honest. Mark down that he has been arrested, and send a copy of the dismissal (as well as take a copy to your interview). The arrest should not present a problem since the charges were dropped, but if you failed to provide them the relevant information, that would be a problem. Chances are they will know it was dropped anyway (as a result of biometrics) but yo still must provide them with the documents yourself.

You should be fine, then. :) At our AOS interview, the interviewer looked at the dismissal paperwork, said something along the lines of, "Oh, you were arrested but it was dismissed and expunged" and didn't even ask about the circumstances before moving on.
