Case Complete but recieved RFE (Checklist Letter)

Hi,

We confirmed, via AVR, that our case was completed Jan 19.

However, the next day we received a Checklist letter, dated Jan 20, which said,

"______F - FINANCIAL EVIDENCE:______________________________________

The NVC has received the information you have submitted in reference to

the Affidavit of Support. Please be advised that you, as the Petitioner, do

not appear to meet the minimum income requirement according to the

current poverty guidelines to sponsor the intending immigrant(s) for this

petition. The consular officer will make a decision regarding this

requirement at the time of your interview. In order to avoid delays, you

may wish to submit an additional Affidavit of Support (Form I-864) for a

Joint Sponsor to the National Visa Center to assist in sponsoring the

intending immigrants. To view the current poverty guidelines, visit

http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending

immigrants, please note that you the sponsor may not use Form I-864EZ

and will also need to submit Form I-864."

It was obvious before I submitted the AOS that I wouldn't meet the income

requirements as I'm living with my wife in AUstralia and don't have any US

source income. Because of that, I arranged for a joint sponsor and submitted

the joint sponsor's I-864 along with mine to the NVC. The joint sponsor clearly

met and exceeded the income requirments.

So...why does it say I may wish to submit an additional AOS form for a joint

sponsor if I already have? Did they lose the joint sponsor's I-864?

Give a call to NVC and see! Is your co-sponsor a U.S. citizen or LPR?

I would call the NVC ASAP.

on Monday USA time, call into NVC, ask if the casefile 'list o documents' shows the I-864 from the joint sponser / co-sponser or not show this.

If it doesn't show this, ask for a supervisor, remind the supervisor this document exists and ask them to do request an eyeball review to find it. Note the supervisor will not lay hands on yer physical casefile to accomplish this task, but will request the search to be started.
