A brief rundown of our situation:

Canadian-born (with Canadian citizenship) immigrant entered on K1 visa in May. We married within 90 days. Have received AP and EAD joint card, and have AOS interview scheduled for next week. Took a recent trip back to Canada for Christmas, and returned to the US days later. Upon return to the US, immigration officer did not recognize the Advanced Parole joint card, and allowed us to cross only after showing him the AOS interview appointment letter. The immigration officer ripped out the I-94, and did not stamp the passport of the Canadian immigrant.

We have read plenty of threads that state interviewing officers have requested the I-94 at the AOS interview. Will this be a problem for us at our interview next week?

02/16/2012 - Email notice that USPS picked up the EAD on 2/14/2012
02/16/2012 - EAD and AP Card received
07/19/2012 - Contacted Congressman
07/26/2012 - RFE Text and Email received
10/23/2012 - AOS Approval text
10/27/2012 - Greencard received!

I believe you had to submit a 2 sided photocopy of your I-94 with your AOS isn't? Worst case scenario, you can bring your extra copy and explain why you don't have the original anymore.

US citizen since April 2016

ROC completed April 2014

AOS from K1 completed February 2012

Should have been more clear. We handed him AP, passports, and declaration forms at same time. Officer said there was problem as we were trying to cross on an apparent "expired visa". He may have been looking at the K1 visa since he made the statement that the issue was with our (non-existent) K3 visa. We explained it was K1 not K3, and that our case was awaiting an interview and that the AP card had allowed us to travel abroad. He didn't really give in until we handed the AOS appointment letter, and advised us to bring it with us whenever leaving the country.

I do not know why so many people think a K-1 turns into a K-3 when you get married. Workers at social security offices have been known to do this and turn people away for their SSN because they are married and now "K-3". I can more understand them not understanding immigration visas, but CBP officers should know this stuff. It is their job to.

Take your copy with you to the interview and if they ask for the original I-94, just explain what happened. They did not ask for or take my husband's I-94 at our interview, but I know most people seem to be asked for it.
