Just a quick question about when to file the AOS... Im thinking in advance - when i arrive in the states - we arrange our wedding and get married - is there a timelimit by which the AOS has to be filed?

Our plan was to get there arrange the wedding, get married, find and buy a home and settle in then apply for AOS so we dont have to change addresses later on while waiting for the AOS. Im intending on buying a home right off with the money I have from selling my home here, and then that will save us some money on paying rent, with that money we can get insurance. I know the marriage has to take place within 3 months of arriving in the states.

27 Feb. 2006: K1 petition sent to Nebraska Service Centre

2 March 2006: NOA1 dated (received in mail on 9 March 2006)

4 May 2006: NOA2!!!!! (DAY 66)

8 May 2006: File Sent to NVC (as stated on email dated 9 May)

24 May 2006: NVC sends our file to London Embassy

8 June 2006: Packet 3 arrives (DAY 101)

25 August 2006: Pack 3 sent to London Embassy registered post

29 August 2006: London Embassy receives my Pack 3 - 9/9/06 pack 4 arrives

SEPT 2006:APPLICATION PUT ON HOLD - WE HAD A FALLING OUT.

MAY 2007:RESUMED THE VISA APPLICATION

6 June 2007: Medical @ 2.30pm - need to get anew GP letter and psychiatric evaluation

7 June 2007: INTERVIEW @ 10am - waiting for new police record letter

3 July 2007: APPROVED/Visa arrives

You probably want to post this in the AOS forum, but you typically want to file for AOS soon after you are married and have the marriage certificate in hand. The sooner you file, the sooner you will get your conditional green card. Also note that you can't file for EAD until you file for AOS and without that you can't work legally here.

Technically, you are supposed to file for AOS before your I-94 expires after entering on a K1 visa. USCIS is usually forgiving though of those that file for AOS a little late, though I wouldn't recommend waiting for more than 6 months.

As long as you marry within the 90 days of entering the US you are forfilling the conditions of the k1 visa. The AOS can be filed whenever you want but most people want to file for it asap as it can take a while to get your green card and without it you cant do alot.

February 16th 06 - Biometrics Appointment

February 22nd 06 - EAD Approved via e mail

February 27th 06 - EAD card in mail!!!

March 6th 06 - Got a job!

The visa is good for 90 days so supposedly you should get married and file the AOS within that timeframe. Others have run past the 90 day thing and didn't have a problem but there is always the potential.

OK ty all for your responses I just wanted to see where we stood when we get to that stage - so I have been thinking after reading the responses we may as well file the AOS before we find a home, The address we put on the forms is his mums house so I guess it wouldnt matter too much if at a later date we changed the address.
