Canada to US Work Visa

Hello all, am terribly conused and don't know what can be done. My boyriend is trying to get a work visa for the US (he's a Canadian citizen). He has an employer who is willing to vouch for him/whatever the term is, but I don't know what the paperwork the employer needs to fill out is? He's a cook, associate's degree.

The employer needs to sponsor him and pay the fees and file the visa papers - they should know and do this research themselves not you.

Yea, but the employer has no idea where to start. She's a small business and has never done this before, so a direction would be helpful? Sorry if this is wrong to ask.

I think it's an H1B visa. If he's a chef, its possible it would be an O-1 since that is the artist category, but probably H category. You can also search for the TN visa and see if his occupation falls under there. I would try and get as much info about it yourself, before consulting a lawyer involved.

Small employers will generally not pay for a work visa. They are extremely expensive.

Just checked the H1B and the cap count is over filled already for 2012. He wont get one of thos.

yes, that does happen! also, GC lottery, and check out the TN and O visas!!

I just checked the TN list and it wont work for him. Cook is not on there and he only has associates, they all require bachelors degrees.

Don't think an O-1 will work either since its very specific as to the position

Canadians are not allowed to sign up for or use the GC lottery lol. Unless hes naturalized and applys based on home country.

You do not need to know actually his involvement is very limited. All the work is done by the Employer's Lawyer.

I have heard of Chef's being sponsored from India, China etc, what skills does he have that are so attractive to the Employer?

Hi, thanks for all your replies. Basically I am just trying to get him a visa to move here so he can work. We've been dating for 4+ years, but I don't think the fiancee visa is right, and I have several close connections that are willing to do this as a favor for me (small business and large).

Sounds like all you do is run up legal fees for them.
