Hi...Im new in VJ and as I was browsing on the previous forums and timelines (to update me with some info), I came across the unapproved K1-- only after a couple months from their NOA1?? I dont seem to understand it..should they be asking RFE or just send you a notice that they did not approved you?..

I dont know if anyone heard anything how this process goes- being unapproved after NOA1..just asking because it does not make any sense to me? I am still reading previous forums ,if I can get info about this right away that will be great.

Any info at this time will really calm some of this nerves, this is such a journey :)

Yes USCIC can deny a case without sending an RFE. RFE is send if they need additional information, however in those case, all the required information was there, however the requirements were not met for the approval and in this case USCIS can deny it.

It can happen for a variety of reasons. Most people will receive an RFE if it's a simple fix (more primary evidence of having met in person, someone missed a signature or date, a divorce decree, etc.)

A denial at the petition stage could be due to a criminal background, misrepresentation of information, couple did not meet requirements (ex: have not been together in person within 2 years of the petition filing), complete lack of information (more than a simple RFE can fix). Etc. It's more rare, but it can happen.

As long as you're both free to marry (if either party has been divorced, submit a copy of the divorce decree), provide evidence of meeting in person in the last 2 years (passport stamps, boarding passes, and pictures as secondary evidence), and everything else in the guidelines/instructions...then you'll be fine.

*Started the AOS process a bit late cuse I'm a slacker and suck

But, we've had no issues. It's coming along. Interview should

be shortly coming. Married life is great*

i knew someone who got denied after 30days...its becoz they only sent the i129f form without any evidence. they did refile with a complete packet the seond time and got approved in just 3 months
