Hello everyone,

I was wondering if anyone can help me. I submitted I-130 for my wife while I was an LPR. The petition was approved, sent to NVC, and after all docs were sent to the NVC, the case was completed. Because, I was LPR, my wife had to wait until her priority date would be current. While she was waiting, me and my wife got our first baby. When I called NVC, the rep told me that I need to send the copy of my daughter's birth certificate, and they added my daughter to my wife's case. I sent all the needed docs for my daughter as well including DS-230, the affidavit of support, two passport style photos and the application fee, and after that the case was completed again.

I learned somewhere in the internet that when you become a USC, you have to file a separate I-130 for your child because she loses her derivative status. Because I was a few months from becoming a USC,I submitted a separate I-130 for my daughter that was also approved, sent to NVC and assigned a case number (different than that my wife has). After I became a USC, I upgraded my case for my wife to transfer her from F2A to IR. I didn't update my daughter's separate case, however. Recently, I called the NVC to check the status of my wife's case, and the automated voice stated that the case was upgraded, completed and transferred to the local Consulate office. I am confused now. I expected that after I upgrade my wife's case from F2A to IR, the NVC will tell me that my daughter can no longer be eligible for her derivative status and will need a separate I-130. But they never did. They just completed the case and transferred it to the consulate.

I know it may sound good because my wife will be scheduled for her interview soon. On the other, I am getting nervous that they will just issue a visa to my wife, but not my daughter even though my daughter is in my wife's case. And I really don't know what to do. Should I tell NVC, or just leave everything as it is.

Here's a thought?

Call into NVC, get a Human, give all 3 case numbers, inquire for status on all 3 casefiles.

They be the ones with the crystal ball here.. .

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Call into NVC, get a Human, give all 3 case numbers, inquire for status on all 3 casefiles.

They be the ones with the crystal ball here.. .

Yes, I hear you. I actually tried to reach a live person first, but NVC has a federal holiday so no live assistance was available at that point. Instead, I had to listen to the recording. On the other hand, is there any point to call NVC if they already transferred my wife's case to Consulate. Do you think that we should just call the Consulate once they schedule an interview for my wife???

I have great news:) It appeared that NVC actually upgraded both my wife's and my daughter's status. Cases for both were completed, and transferred to Consulate offices. I guess the only thing is to wait for an interview to be scheduled for them:)I can't believe that it is finally going to happen:)

Now for yer next trick:

Whatever the FIRST appointment is, whoever it's for -

ask that the OTHER person's appointment is the same day.

Whatever the FIRST appointment is, whoever it's for -

ask that the OTHER person's appointment is the same day.

Most likely, this will be the case automatically. If not, just communicate the issue and either NVC or the Consulate will be accommodating. I would contact NVC with this request right away. I expect they'll say, "Well, of course. That's what we're planning to do anyway."
