Tourist visa while waiting

I want to say for the record.....our immigration system is broken!!!! Maybe I didnt do my homework but I did speak with a retired USCIS (INS) individual who recently retired and they asked why I didnt try to bring my wife here to visit under a tourist visa? We began looking into it and didnt see anything wrong, especially since I can loose my job for shenanigans even if we did try a fast one on the system. My wife who is currently in Barranquilla, went on line to the site and filed for an appointment which was today and was flat out denied. She took a day off from work, flew across the country, paid I think 120.00 USD, and was told NO..because they said she has pending visas. The thing that really ticked me off was that all the guy did was ask, have you ever been to the US, she said yes (she was a student at a summer program). He asked what her business in the states would be. She said to go be with my husband for the holidays. He asked when we were married. She told him the day in July. He said he could not permit this and she will have to wait for her immigration visas. That was all.

The bottom line here is: If you have any inclination to have your spouse come to the states to visit........FORGET IT!!!!!!

Now I have to go back in January because she is devastated and these cold bastards could care less. IT WAS FOR A VISIT!!!!!!!

This is of topic but does anyone know what the deal is with CSC? Our i-130 was early AUG and i-129f was late AUG......Anyone?????

I hate to play devil's advocate but they're in the right on this one. Unfortunately, they cannot give anyone a tourist visa if they believe there is a possibility the person might stay in the US without any guarantee that he/she will go back to their home country before it expires. On top of that you have a petition pending for a CR1 visa which will get an automatic denial for a tourist visa. I'm surprised the retired USCIS employee didn't tell you this as it's common knowledge.

But let's assume you didn't have a pending I-130 with the USCIS, or that you're not even married, or that you're not even dating, the possibility of your wife, or anyone else, getting a tourist visa to the US is only 5%-10% given the amount of fraud the US embassy sees on a day to day basis. That's why every time anyone who goes to the US embassy in Bogotá to get a tourist visa needs to be prepared that they will be flat out denied, if they get it, fantastic! But if they don't, which is usually the case, then at least they were prepared to lose time and money.

We are fully aware of the potential for visa fraud and I dont have many hates....but that has made it to the list. What makes it all the more frustrating for us and sorry if I seem as if we are the only ones but...Our relationship which our desire to marry is based on is exclusively bound in of Christian faith. I dont mean Sunday and out....we are trying to begin our lives and work on Spanish outreach, travel for God's glory to those who need it, and worship together as one. So, though we are supposed to be of the understanding of everything on "his time", we are human and we hurt, and we pain too. Maybe the thorn is in my heart vs Paul in the flesh. And so God's grace was enough, I still beg for his mercy to please hurry. 2 Corinthians 12:7

I'm sorry that you went through this. What is incredibly galling is that were your wife from any of the VWP countries she could just hop a plane and fly over. They might give her a bit of a hard time at POE, but would likely let her on in with a fraction of the proof required at interview.

It's been said before: If you're from a non-VWP country your chances of a visitor's visa are pretty damned slim in the first place. If you're married to a USC who isn't living with you, the chances are zero.

"Do you know anyone in the US?"

"Yes, my spouse"

"Denied."

We thought about trying it ourselves. We already failed horribly before we were married. Didn't feel like going through that again.

You know, giving how mindnumbingly impossible it is for people to come here legally, I am no longer surprised that so many do come here illegally. This situation really just demonstrates to me once again that the only ones punished by these laws and processes are the people trying to do things the right way. Those fraudsters you mention and other illegals are likely laughing their asses off at us jumping through the hoops.

People from VWP countries can easily do, and often do, that infamous mind change. Why screw around with the long waits and being apart when they can just fly over and "suddenly" decide to get married. I would find this entire process a hell of a lot easier to defend and justify if it wasn't such a steaming pile of #######.

Sorry for your experience but unfortunately immigration has nothing to do with Christian's faith and God's grace...

The God in this case is sitting in the USCIS and Embassy.
