My fiance ( she's from Jordan BTW) and I are getting married over seas next July. She already has a 5 year tourist visa that was issued to her last year and we are planning to have her visit once we marry there. My question is about POE;whats the best route to handle officers at POE? i know we will have to plan documentation to tie my fiance back to Jordan for best arguments if needed. She will have bank accounts, return ticket, car registration but nothing too solid as a job. She also has a brother who lives in California that she wants to visit directly when she leaves Jordan. IF she is asked the purpose of the visit and questioned further, would you guys recommend that she says she's visiting her brother and husband or just brother? at the time of entry i wouldn't have filed CR1 yet. I just want to ensure that we don't have any complications with the immigration visa once i file if she doesn't say she's also visiting me ( her husband).

I know its difficult from what i read if she mentions a fiance or husband so its worrying me she will be sent back home if officers at point of entry are not convinced she is planning to return to Jordan to finalize immigration paperwork.

another question is, we were planning to have her return ticket after 6 months ( hoping for the 6 month allowed visit) but i am rethinking about it to only purchase a return ticket for 3 months as the 6 month return ticket would look kinda suspicious, thoughts on that?

i know its a crab shoot at POE with the officers you get, but i am planing for the worst and hoping for the best.

Day 1/4/2013 - received text/email that case is ready to be scheduled for interview !

Day 1/15/2013 - received hard copy letter to let us know interview is on 2/12 !

Day 1/17/2013 - received text/email that EAD has been approved

Day 1/26/2013 - received EAD card

Day 2/12 - interview done - approved on spot!

First thing, Dont lie at POE.

Since she really doesn't have strong tie to return to her country, then there is most chances that she wouldn't be granted the access in USA.

Lets say if you book 3 months later " Return " ticket, but she gets back after 6 months, then that would be next unwanted trouble. ( Esp at the interview for CR-1 Visa )

Lets say if she says that she is visiting her brother, but actually she is really spending the time with you, then it would be next trouble at the time of CR-1 Visa interview. In Form DS-230, she would have to mention the stay in USA, and their purpose, timeframe.

Overall, such activities can make the complex.

Making false comments at POE, can cause a BAN.

Overall, whatever there is, just say honestly at POE.

If she cant meet with the requirement to show the strong ties, you may better visit her time to time, so that will make your case more stronger.

so from what i gather, its OK to do this move to have her visit as long as she's honest and doesn't over stay. As i mentioned she does have a return ticket, bank accounts, car registration but they are not that strong of a tie in my opinion. I just want to make sure there is no compilation when i file for CR1.

I also should have it in my mind this is not guaranteed entry and if she's returned to be OK with that as 'it is what it is' kinda mentality. We tried and didn't work.

She has to be honest about the timeframe at POE. Like if she says 3 months, then she should stay 3 months even her visa is valid for many years. Because they keep such data in their system, and can use to verify the words authenticity of the person. So overall if she intends to live for 6 months, then she should stay 6 months.

Honestly return ticket for 3 months later doesn't sound strong ties. If return ticket is max within a month, then it makes more sense to me. As long as she is clearly honest about purpose of stay, timeline at POE, then that is fine. If they let her in, then that is great! but if they deny her entry, then she should be okay with that, and wait for CR-1 to complete.

when does she need to be back in her home country to start the interview process, medical examination and such? if she some how stays for 6 months doesn't she have to start the paperwork once NVC sends her the packet?

once NVC sends her the packet?

:ot: When a case number is assigned to your file, you don't have to wait for the NVC to send anything. The forms can be downloaded from the web. While you are waiting for your NOA2, work on obtaining the needed documents that will need to accompany the forms. Also, when the bills are invoiced, pay them and once said bills indicate paid, send the packages.
