Hello,

Actually My parents are in USA on Greencard. My brother is over 21 years and Unmarried. Can my parents put the file for him? and how long it takes to get his Greencard? my brother is also here and he is on student visa.

your parents can petition for your brother - yes!!

The case category (unless the petitioner becomes a US Citizen will be - FB F2B

based on current processing times your brother would receive his green card in 7-8 years.

Your brother MUST remain in legal status to adjust his status from a F1 (student) to F2B (LPR) otherwise will have to return to his country to continue visa processing.

Current cut off date F2A - Current

May 12 2011 - Notice of Action 2 (NOA2)
May 23 2011 - NVC case # Assigned

thank u for quick reply but if after filing for my brother my parents will be citizen in 2 years then what should be the years for process?

you are welcome. The years to process the case will not show much improvement .. take away 2 years. so 6-7 years. he could also seek alternative routes to become legal if he wants to or since he is a student then he could just wait.
