I have been searching for an answer for a while now. This is a bit tricky.

I will send in my petition to remove the conditions of my permanent resident card tomorrow.

My current card will expire on 12/15/2011.

I will leave the country from 12/20/2011 until 01/10/2012.

Two Scenarios could happen here.

1.) My CIS will arrive in the States while I will be gone to visit my family in Europe.

Then I could have my family here send me the CIS receipt via international 24hrs. shipping and enter the country normally.

2.) My CIS will NOT arrive while I am gone.

Can I enter as a tourist just until the CIS comes, then leave the country again and re-enter with the CIS receipt?

This is driving me crazy! Anybody has an answer?

You will almost certainly NOT be allowed to enter the US with an expired green card and no NOA1 extension letter.

It is remotely possible, in that circumstance, that they could parole you in on "humanitarian grounds", but you might as well plan on winning the lottery.

On the bright side, if you send in your RoC packet tomorrow, you will virtually certainly have your NOA1 extension letter significantly before the 20th, particularly if you spring to have the RoC packet overnighted to USCIS. I mailed my RoC packet on November 1, it arrived the 3rd, the NOA1 was issued on the 3rd, mailed back on the 7th, and arrived on the 10th.

If your NOA1 arrives at your home in the States while you are gone, they can, as you say, mail it to you and everything will be fine.

It would be highly unusual for your NOA1 not to have arrived at your home by January 10, if you mail the RoC application tomorrow.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
