Hi,

My husband (the petitioner) and I live together in Singapore. When filling in Part B. Info about the petitioner, should I whether put our current address in Singapore or my husband's U.S. home address?

Also, in Part C Q.21, give last address at which we lived together. We moved to Singapore together after we got married. And before we moved to our current place, we lived in another address in Singapore for a year. So, should I whether put our current address or our pervious address?

Thanks much!

Hi, we're in the same situation (living in France) and we called USCIS because we had the same questions.

The answers were, in part B give the address where your husband officially resides now: for us it was France. When he moves back to the states in January, we can file a change of address for him.

In Q21, since you live with your spouse right now, give your current address.

CR1 Visa

Thanks for your reply. But my husband won't move back to the states until he finishes his PhD in Singapore which happens in Dec 2013. I want to get a green card, so that I can study in the U.S. before his graduation.

I will be living with his parents, and he lived with his parents before he moved to Singapore.

The embassy in Singapore recommended me to apply for student visa, I can adjust my status while I'm in the U.S.. But it's gonna cost US$790 more to try to get a green card. (Student visa $140 + adjust status $1070/ Apply green card while I'm out of the U.S. $420)

Also, I will have to pay more school fee as an international student. That's why I decided to apply the green card now.

BTW, I was just double checking this address issus, because I email the U.S. embassy Singapore, and they replied that the petitioner should write in his U.S. address in Part B of the I-130 form.

But now after reading your reply, I'm not really sure what I should write.

Thanks for your reply again!

You should talk to the embassy again, but I don't think you can get a IR1/CR1 visa if your husband doesn't live or intend to move back in the USA. These visas are made for people to be able to join or follow their spouses in the US, not live there without them.

I talked to the embassy again today. And they said I can still apply for the green card, it's not necessary for my husband to go to the states with me after I get the green card.

The terminology is getting all mixed up here. First, you do not apply for or receive a green card through an Embassy or Consulate. You'll be applying for an immigrant visa. Once you obtain the visa and use it to enter the USA, you'll be entitled to a green card and it will be mailed to your US address. In order to obtain an immigrant visa, your husband must show his intent to re-establish residence in the USA. You may not travel to the US ahead of him but he can return to Singapore after accompanying you to the USA.

Getting correct answers requires, at minimum, asking the correct questions of the actual people who know the correct answers.

Will you be filing by mailing the petition to the USCIS PO Box in Chicago or filing it directly with the Embassy/Consulate in Singapore? If mailing to USA, use the US home address. Otherwise, use the Singapore address. CQ.21 answer would be your current address in Singapore.

I'm in the same situation as the OP, except there's no DCF in France anymore, and we called USCIS to make this point clear: they told us to write the address in France, although we were filing through Chicago lockbox.

Thank you for the correction. It's the immigrant visa I'm applying for. Yeah my husband intends to move back to the USA after he graduates. And if it's necessary, he will accompany me to the USA.

I have to mail the petition to the USCIS PO BOX in Chicago as they don't have a public counter in Singapore. I have read that there might be issue if the petitioner's address is different from the address where the beneficiary intends to live in the U.S.. I thought that was the reason why the embassy told me to put the U.S. address. But then, the reason might just be what you explained.

The primary reason to show the US address at the top of the petition is that's the address USCIS will send notices to. It's also good to show that the immigrating spouse intends to live at the foreign spouse's address of record in the USA. You may want to include evidence the petitioner has a home/domicile in the USA, even though they are currently studying abroad.

What kind of evidence can I include? My husband lived with his parents before he moved to Singapore to study. He had to write down his residence address in last five years while filling in G-325A, and his U.S. home address is included. Do you think it will be considered as evidence the petitioner has a home in the USA?

That and his driver license and bank statement indicating that's his US address, should be enough.

His driver license is registered with an address he lived at before he moved back to his parents place. I will try to find a bank statement. But where should I attach these document?

Btw, I have a question about filling in the forms. Should I fill out the forms COMPLETELY without an empty space? For example, I don't have a middle name, should I put NONE there? Better put N/A or NONE than leaving it blank? When to use N/A or NONE exactly?

Would you please see the attached file to check if I use NONE or N/A correctly. Thank you very much.

Yes, this is the correct usage of none and N/A but for no middle name, use ---- "None" is actually a name in more than one language.
