Hi,

I english but living in Australia with my US girlfriend, I've spent days looking into this (!), but I can't seem to find any definite answers:

It looks like it is best for me and my girlfriend to get a CR 1 visa, but here are my worries:

1) My girlfriend and I live in Australia, and I *think* that my girlfriend has to be living in the US in order to sponser me? Can anyone shine any light on this?

2) What's the score with the financial support thing? If and when we move to the US, neither of us will have jobs, but we will have savings and will be living rent free at my girlfriends parents. The savings are mine, but could easily be moved into a joint account.

She has to prove domicile in the USA.

She does not have to live in the USA during the process or to sponsor you.

If she does not meet the requirements to sponsor you then she needs a co-sponsor.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

As Inky already posted, she only needs prove she has a USA domicile (or is in the process of re-establishing a US domicile); she does not need to be living in the USA during the process.

In order for her to qualify as a sponsor, the threshold is 125% of the poverty line for household count (2 in your case). If she cannot meet that threshold, a joint sponsor is required.

Thank you both, it looks like a joint sponser will be required, and luckily that isn't a problem. I assume that I would send in 2 I-864 forms at the same time?
