Hi. I am getting married to my american girlfriend and I will be applying for CR-1 visa. We live in border cities

and I will keep my job in Canada. Question is will I be able to cross the border to visit her while my visa application is in process? I will maintain my ties to Canada. My job, house etc...

No you will not be able to visit the US as long as your application is in process.. I am in the same situation, we filed in July 2009 while i was with my hubby in Florida, and to maintain my permanent resident i returned to Canada on September 2009 and I was leaving to go back to the US October 2009 but the US custom at the airport didn't allow me to board the plane, they told me as long as my case is processing, I cannot enter the US.. After being turned away at Pearson Airport I was heartbroken since I was pregnant with Twin and I decided to try my luck crossing the border by car, that was my mistake, I was being held for hours under questioning as to why I am heading the US, I told them I am heading to Cleveland to my aunt, that was my darn mistake, after 10 hours of questioning, they cancelled my visitor visa, and banned my for 10 years cause of misrepresentation, but thankfully we filed the waiver and they approved my waiver, just awaiting my visa in my passport via DHL..

My advise to you would be, just sit out and wait the 5-6months for your application to process, before you know it time will fly by..

YES they can visit each other. All you need is ties to Canada to enter the USA. People do it ALL the time.

Your problem is not this persons problem.

OP, Inky is correct, you are allowed to visit while the petition is pending. However, you need to be prepared to be turned away at the border.

People go across the border with a CR-1 in process all the time. My husband has done it three times so far. Just bring proof of your ties to Canada, be honest, look the CBP officer in the eye and you'll be fine.

To shamNshabana; you could not prove ties to Canada, then to make it worse you tried to cross after a previous denial, misrepresenting yourself. THAT got you the ban, not the CR-1 process.
