K1 China I-129F Send in tomorrow

Hello again....

If I send in my I-129F tomorrow to VSC what would you expect my best case and worst case would be until the interview date? JK

The petition is for Mainland China, i.e. Guangzhou.

I am the one with the J1 visa 2 year rule. It is up in 10 months exactly. I've seen some people that are done in 8 months some in only 5.

2. Will the consulate issue a K1 visa for someone still subject to the 2 year rule (say 1-2 months left) with the thinking that a person will have 6 months to enter the US after the visa is issued and can thus serve the remaining "sentence?"

3. If you wanted to have the interview around July 2007 for China, when would you send the I-129F?

4. What would happen if I got through the entire process in 5 months and still had 5 months left on the 2 year "sentence?" Anyone know?

5. Who will take will Congress in November. JK

p.s. As you can see, I am trying to "time" the filing of our petition so as to get the interview around July 2007.

Your best source to get a handle on time estimate is the Timelines here on VJ.

Go to the timeline page select K1 advanced view, and filter for China, you will be able to get an Idea for NOA2 to Interview this way, for performance at VSC filter further by service center, or back off the consulate filter and just look at cases filed at VSC to get an idea for Filing to NOA2.

Our case took about 30 days at VSC, then another 3 weeks at NVC. I used the timelines to get a fair estimate for NOA2-Interview of about 196 days at Guangzhou.

You can also see my thread on the variability of the visa process for China. Each step after NVC is quite variable. This makes it difficult to guess an interview date with much precision - it can easily vary by 1-2 months more or less from the average.

A good place for info on Guangzhoc and the visa process for China is Candleforlove.com. Everyone at that site is in Chinese-American or Asian relationships and has some great info. Me and my wife were very lucky and we have one of the quickest timelines that they have seen. I was very lucky and everything seemed to fall into place. I also grew up in Rochester and Webster New York and moved to Maine in 1970. Good luck in your journey.
