Hi Vj

Can I a file a petition for my fiance at the same time that his employer? or after if the employment visa is denied? Thanks :-) Opinions will be appreticiated I'm worry about this causing any issues,I don't know if is better for him to just declined the employment visa option,can you file both at the same time?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Correct, you can file both. Correct, they may see this as someone trying any possible route to get to the USA. If he has also filed for other visas in the recent past (less than 2-3 years) it is a big red flag.

what is your realtionship history? How long? etc. (you do not have to tell us here, but that is what they will look at, always consider the pessimistic point of view, that is what they use) Red flags can be overcome but it requires a lot of evidence to show that is NOT what he is doing.

Thank you so much for your response,yes he has filed before for an employement visa I will say like back on Jan,so there we go :wacko:,your answer confirmed my feelings, since I believe that his employer have not filed yet I'll try to convince him to hold on that,looks like we will have a hard time.
