So as our interview date nears and we are getting everything ready, we have come across a bump on the road.

I started working at a company this year and make enough to cover for the affidavit BUT I get paid in cash and so the only proof I can have is a letter from my employer. In the past years I have not really had a stable job and it reflects in my income tax return. I have last year's tax transcript (first year I filed) which reflects almost nothing in income. We are trying to still find someone that can co-sponsor but as the date nears, we are running out of luck.

If need be and we do not find a co-sponsor, will the etter from my employer be enough?

(please do not turn this into a tax evasion discussion, you can have that conversation elsewhere, especially because I have not stated that I will not be filing with a 1099 at the end of the year (which I will).)

P.S. For those of you who have recently gone to the DR Consulate...how many of you have been asked for the affidavit of support documentation?

Assuming that you have the same embassy experience as Carol and Lenin (no I-134 required) there is still adjustment of status in your future and that will absolutely require an I-864 affidavit of support. And you will have to document your income claim with more than an employer letter. Your quarterly tax deposit (income, social security, medicare) receipts (required if you are getting paid as a contractor rather than as an employee) would be good documentation to submit in support of your income claim.

With a co/joint sponsor the petitioner would still complete the affidavit of support. So it would be worthwhile to complete the form and have all supporting documents available to avoid a possible delay while you produce the I-134 (or later I-864).

I do not think I have ever read of a request of the I-134 during a Santo Domingo interview. We certainly did not need to submit it (even though I had prepared it and was ready to give it, if necessary). However, once he comes to the USA, marries you, and you prepare his AOS, you will need to submit the affidavit of support as part of the complete AOS package. Is there a possibility that you could get someone to co-sponsor your fiance?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

for fiance visas. Santo Domingo Embassy does not ask for affidavit of support form I-134. You should be good for now. But when you apply for adjustment of status, I believe you do need to file a i-184 affidavit of support.
