iam a uk citizen applying for k-1 visa, i lived in usa for 9 years i was arrested at the age of 15 for possesion of cannabis and went to court. it is now time for me to disclose this information but will this show up on the background check they do before they sent my information to the embassy? i was a minor so will this show up? is there any way i can find out if this has shown up on my background check?

If you were arrested, then there is a police record somewhere. You can't take the chance to say "no" to something like that, even if juvenile records are not published as public records. There is no way to know what shows up on your screenings. So have you been to the US recently on VWP? How did you answer the drug question?

i said no to the drug question on the vwp, this was before i had any idea i would fall in love and apply for this visa. will this come back to haunt me? i was arrested once in america at 15 for possesion of cannabis, then when i was 18 i got arrested for the same thing here in the uk but that has not shown up on the police certificate just says further info stepped down along with a caution for harrasment from a crzy ex gf. are my dreams crumbelling before my eyes what should i do? do i have a chance? iam so stressed about this. would an i-601 form save me from denial of the visa? please any help, does or has anyone had a similar situation.

I know not much about this things, but I think you have to be honest and disclose everything because they will eventually find it out and you could be banned because of that, better be straight and explain things. I wish u good luck :star:

1 of the offences being when you was under 18 and the fact that you had no problem travelling on the VWP has to be a good thing but i dont know enough about immigration law or policy to say how much these things will affect your visa petition. all i can tell you is that you need to get a 'public access request' and 'memorandum of conviction' and that you MUST be totally honest on all the forms that you fill in and at the embassy during the interview. also because you need the police certificate for the medical (they will ask you what offences have been stepped down) you MUST be honest with them too. you will be given a questionnaire to fill in and one of the questions will ask if you have ever abused drugs but what it is really asking is have you ever taken drugs... so you must answer yes.

HOW CAN I HELP THIS MATTER ARE YOU FAMILIAR WITH THE I-601 EXTREME HARDSHIPS FORM WOULD THIS HELP? ALSO IAM RUNNING OUT OF TIME DECEMBER IS OUR DEADLINE CAN THIS BE EXTENDED? SORRY FOR ALL THE QUESTIONS BUT ANY HELP WOULD BE GREAT RIGHT NOW. You HAVE to be honest. There isn't really much choice or other sensible option. If your police certificate says 'no live trace' or 'stepped down' then you can bet your life at some point, perhaps not until the embassy level here in the UK, they will have the power to look further into exactly what the caution/conviction was. I don't know much about this area except some things I have picked up from this forum, but I ve flitted through a few forum posts and found these points, perhaps you'll wish to search further into them....

1) One poster mentioned 'trying' a drug, but was honest about it and is going on to get character witnesses to verify this was a fad and in no way indicative of a current predisposition

2) Another poster mentioned something about stepping down regulations denying entry based on historic use....though I can't hionestly remember what that was for....try looking in the forum and I think the poster titled it something like 'experimental drug use' or something on that nature.

Sorry I can't be much more use than that, but definitely you have to be honest in your application as if you lie and they find out (which they will) it's not going to make you look a very viable or desirable option for U.S entry.

THIS ORDEAL OF BEING AWAY FROM THE ONE YOU TRULY LOVE IS SO HARD ITS LIKE MY LIFE IS ON HOLD I JUST DREAD TO THINK WHAT WOULD HAPPEN IF THIS GOT REFUSED.
