is it allowed for my USC hubby to stay in the philippines?

hi friends! just wanna ask if my UScitizen husband can stay in the philippines for a long period even if we're still waiting for NVC to close our case? we're worried 'bout he's income, isn't it there's a rule about that? what if he has no income because he'll stay with me here, but there's a SURE work waiting for him in U.S. because he will file for an indefinite leave on his job. we're talking 'bout what is the best thing to do 'coz right now we're really down 'coz we miss each other so much! we have no idea what wrong with our papers, we even have our lawyer but we have no idea if it's helping after a year at NVC alone! THANKS!

i dont think there's a rule like that :huh: what i know is, some applicants have their interview with their fiance/hubby. As long as ur hubby have a job (will keep his job) and can prove that he can support financially, it'll not be a big deal :yes:

yup! i knew that it is allowed to accompany your partner during the interview.. but what if we will still have to wait for example 6months? it means that he doesn't have any income for that right coz he will stay with me here in the philippines.. so what should we do if that is the case? is there a specific amount that we should have in our bank? thanks!

A tourist american citizen can stay here for a maximum of 21days and can keep on renewing for up to 14mos. He needs to pay every extension every month around 7-11k each, pay ACR (Alien Cert of Registration card) for P12k then of course for on the 50th day- hotel, food etc. Now, if your husband is struggling financially, it is not a good idea for him to stay here till you get ur visa. Although you miss each other I guess it's more intelligent to look at the future. He must secure his job and can prove he's financially capable to take you in the US. I heard that USEM in Manila denies petition if the money is in question.

If you want him not to be bothered by visa applications and fees, what you can do is meet with him in a third country and enter WITH him in the Philippines and request for a "Balikbayan stamp" on his passport which will entitle him to one year stay in the Philippines at no additional cost. I heard though that you must present your NSO marriage certificate. I heard they won't accept "foreign" certificates.

I know that foreign nationals that is married to a Filipino citizen can stay here for as long as they want just need to renew something every 6yrs. I am just not sure how it works and what are the requirements.

thanks guys! hmmm.. right we've been apart for less than 8 years and we're thinking that we grew apart for so long, thinking 'bout the money & 'bout the future.. NVC can't give us any reason why it is taking so long, so we're searching for some solution now to stay close yet not to waste that 8yrs being apart. yup i remember 'bout the balikbayan stamp-are you sure it's also allowed for USC i think it is better than 7-11k. money is not a big deal for us RIGHT NOW (but of course it's always important and wiser to consider everything), but we're not sure how much should we show them and HOW LONG will we wait for our interview.. THANKS A LOT!

Sounds like the key issue for the two of you will be sponsorship. If your husband has no income, you'll need a joint sponsor who qualifies. All immigrant visas require a qualified sponsor.

A Legal Permanent Resident or a Citizen can act as a sponsor. If your liquid assets are more than three times the amount of income needed for your household size, you can use assets instead of income. If not, you'll need a qualified joint sponsor, or no visa. I would have your husband go online and download the I-864 and I-864p and start studying the sponsorship requirements.

Really? My USC husband is coming also because my visa issuance is taking long, the CO that interviewed me asked for 221g document initially and after he found it to be OK, he came up with some more papers to submit??!! He didn't ask for all of these papers one time first time and wasted a month of wait and it's almost a year now since the last time me and hubby saw each other..we badly miss each other too! :crying: So really, he has to pay for his stay here? Is there a way to avoid this fee? We plan a month of travelling around here and we are both stingy bastards :blush::lol:

Most the time Manila wont accept a cosponsor.

They accept co sponsor if you're filling for IR-1/Cr-1. I'm not sure for K1 though.

Our Timeline- IR-1 Visa : 204 days

USCIS Timeline: 90 days

04.08.11- Send 1-30

04.13.11- NOA1 (CSC)

04.18.11- Touched

07.12.11- NOA2 Yay!

NVC Timeline:- 37 days

08.02.11- NVC Received

08.20.11- Case No. assign/IIN 37 days from NOA2

08.23.11- receives DS 3032/AOS fee bill

08.24.11- Pay AOS Bill/ Sends the DS 3032 thru email

08.27.11- Received IV-Fee Bill

08.27.11- Pay IV-Fee Bill

08.29.11- Sends AOS via USPS

08.30.11- IV- Fee Bill shows Paid

09.08.11- Send IV packet

09.08.11- Received checklist RFE on AOS

09.12.11- RFE docs sends via usps

09.19.11- Case Completed

09.30.11- received interview date (email)

10.11.11- Medical exam.( Passed)
