-USC mother wants to bring her son from Dominican Republic.

-Mother was born in Puerto Rico making her a citizen at birth and her son.

-Her son is 8 yrs old.

-She is NOT married. And was NOT married when she gave birth.

-She is NOT in communication with the father of her son.

If you need more info please let me know.

-Besides form N-600K, what other forms does she need?

-Does she need to do an Aff of Support? If so which one, I-134 or I-864?

-Also what documents?

Any assistance would be appreciated. Thank you.[/b][/b]

The problem is that you have to apply in person. So the mother and the child have to apply at a passport agency. In her case I guess at the embassy. I am not sure how it will work with her not being with the child. Best to go to the webpage of the US embassy in the Dom. Rep. and check what to do. There should be a section about applying for a passport for a minor.

If the child is US citizen then it can get a US passport and it can travel.

Where is the mother? In US?

USC Puerto Rican mother lives in USA, New York City. Child is in the Dominican Republic with USC's mother (childs grandmother).

So she will have to go to Dom Rep to apply for the child in person at the embassy?

IF thats the case what documents will she need to take with her?

It will be best to know what documents to take so that she doesnt have to make an additional trip if she doesnt take something. That would be a shame if that happens. I know that the USC is working part time and taking some classes at a local school. Her income is low.

You need to give us a lot more information if you want a good answer.

Where was the child born? If the child was born in Puerto Rico, then the child is a US citizen.

If the child was not born in the US or a territory of the US (Puerto Rico, etc.), then did the US citizen mother live in the US for at least 5 years (2 of which after the age 0f 14) before the child's birth? If "yes", the the child is a US citizen. If "no", then the child is not a US citizen.

Tell us which apply and we can tell you what needs to be done.

thanks for looking at my Q

Child was born in Dom Rep.

She was born in PR.

She has the residency requirements. She is about 26-28 yrs old.

She went to school here in US from Kindergarten to High school.

She has also worked on/off for the last 8-9 yrs. Paid taxes and filed tax returns.

I have already told her to get her school transcripts and any tax returns she has filed.

The child is a US citizen. Since the US citizen mom meets the residency requirement, her child born outside the US is a US citizen by birth. The child does not need to naturalize. A visa cannot be issued to a US citizen.

She needs to file a CRBA (Counsular Report Birth Abroad) and apply for a US passport for her US citizen child. This is the only way for him to enter the US.

DO NOT FILE THE N-600K. IT WILL BE DENIED SINCE THE CHILD IS ALREADY A US CITIZEN.

Follow this procedure: http://santodomingo.usembassy.gov/crba_main-e.html
