questions about 'evidence'

hi,

by the end of December my 90 day period will begin to countdown for me to apply to remove conditions.... however, my Husband and i do not have a whole lot of mingled accounts except the lease to the house we are renting. We have separate bank accounts because we have different needs in what type of accounts and fees have these days. We do not file our taxes together because my husband has has child support issues and was somehow mixed up in a weird tax refund issue. we do not have any utility bills together, we just decided that he'd transfer the gas and cable bill etc over to our new address and i'd open the electric and water bill in my name. will this be a possible problem? do the affidavits have to be from people who didn't do them for us when i changed my status?

does anybody have a quick list to send me to make sure i get everything sent off?

Your missing a lot of the important things to send. i just wish you luck.

Shared credit cards

joint bank account

joint tax returns for 2 years

shared/joint medical insurance

joint car insurance

both drivers licenses showing same address

joint utility bills

joint mortgage or rental payments

joint deed / lease agreement

life insurance

savings showing right of survivor ship

cards/letters to both people

trips taken together

evidence of these spanning 2 years. Not a couple of months.

AOS was approved in 2 months and 8 days without interview.

Yeah as Inky said you really need to get some joint accounts and utilities together. pics of trips together but what you have is going to be hard to prove for ROC Good luck

Hi Michelle,

Inky has a great list, things that comes to my mind that are less common, but may work:

* Do either of you have a will naming the other person as a beneficiary?

* Do either of you have a benefit through work perhaps that only spouses are eligible for? My employer offers special discounts to our products and services and you have to be a spouse or dependent to receive it

* Do you or your husband have a 401K or pension where the other person is the beneficiary?

* Besides pictures of trips, have you had written communication with other family members? For instance a personal exchange with your in-laws?

I also liked using "official mail" e.g. mail from Social Security, Jury Summons to show we lived at the same address, even if it was not addressed to both of us.

thanks... at least i have time to make some adjustments!

i have photos galore of us over the past 2 years, will they hold up some ground?

The evidence that carries the most weight is the evidence of financial co-mingling. Do keep in mind that they want to see evidence that spans the whole marriage; not an account that you just opened up. Did you at least file your taxes as married/separate?

Photos are ok as secondary evidence but they don't carry a lot of weight. You can get affidavits from anyone you want. I wish you luck in coming up with some good evidence.
