Hi Everyone, I need some advice and would appreciate it from anyone who has been thru the process. After a period of 7 months I finally received my K.1.Visa and entered the US on August 19th. My I.94 expires on November 17th. We married on September 24th and I completed and sent off my I.485 on 7th October to the Chicago lock box. Yesterday I took and passed my American driving test but was only issued a licence up to the expiration of my I.94 the clerk telling me I would need an extension letter for my I.94. From the timelines my AOS if approved will not be thru before the I.94 expires, does this mean I will have to leave the U.S. does the fact I have filed the I.485 form give me an automatic extension. Thanks for any advice.

Don't worry you will not need to leave US, as long as you filed and got NOA-1 for I-485 you are fine.

October 26, 2010 - I-129F sent to VSC

November 2, 2010 - NOA 1 hard copy (dated Oct. 29, 2010)

November 5, 2010 - Touched

April 15, 2011 - NOA 2

June 21-22, 2011 - Medical (passed! Thank you Lord)

July 19, 2011 - Interview (passed! Thank you Lord)

August 11, 2011 - POE (JFK)

AOS Timeline

Sept. 26, 2011 - I-485 & EAD sent to Chicago Lock box

Sept. 28, 2011 - Text/Email notificaion receipt

Oct. 4, 2011 - NOA 1 hard copy for I-485 & EAD (dated Sept. 30,2011)

October 11, 2011 - Biometrics Letter received (appointment date November 2, 2011)

October 24, 2011 - I-485 transferred to CSC

November 2, 2011 - Bioemtrics done

Dec. 1, 2011 - EAD card production

Dec. 9, 2011 - EAD card on hand

Feb. 10, 2012 - Green Card production

Feb. 16, 2012 - Green Card on hand

While the I-485 is being processed, you will have legal status to stay in the US. Do not leave the US until you have immigration advance parole or a green card. If you leave the US without one of these, you will abandon your I-485. DO NOT LEAVE THE US UNTIL YOUR GET ADVANCE PAROLE OR A GREEN CARD.

A driver's license is a state issue. It varies among the fifty states. Some states will only issue a license while a person has legal status in the US. This ends up leaving folks like you in limbo after the I-94 expires and before receiving a green card. Maybe someone from your state can help you with this issue. Unfortunately, there is very little that the immigration folks can do to help you on this issue with your driver's license.
