I'm slightly confused by the Affidavit of Support, even after looking at the instructions. My husband is presently a student and as a result did not make any income over the last three years, ergo did not file taxes. His mother is our co-sponsor and makes well above the poverty guidelines and had no difficulty filling out HER I-864... but for my husband, does he still submit one even though he has zero income to report? And if he does, waht does he answer for #25?

It has the following box to check: have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year.

But no option for not filing and offering an explanation?

The form instructions (page 8) explains what a sponsor not required to file a tax return must submit.

The petitioner must submit an I-864 regardless of income.

Goodness, Ii read the instructions three times and had my husband look at them and somehow we both missed that. Thanks so much!
