Filed I-30 but how about a tourist visa?

I filed an I-30 for my husband in augest and we are waiting for NOA2. My question is can he go and try and get a tourist visa to come visit me? Also, if he does go and they deny him, they will stamp on his passprt no-visa, but would that become a problem too? I really want to see him but dont know how without messing things up..

USCIS STAGE

8/22/2011: NOA1 EMAIL(never received a hardcopy nor txt)

3/23/2012: NOA2 EMAIL!!!! :D

3/28/2012: NOA2 HARDCOPY

NVC STAGE

4/09/2012: NVC Recieved

4/24/2012: Got NVC Case# and Invoice ID#

4/25/2012: Sent DS-3032 email and Paid AOS fee

4/26/2012: AOS fee showed "paid"

5/2/2012: Sent AOS Package and NVC accepted DS-3032 email

5/4/2012: Received and Paid IV fee

5/7/2012: Sent IV Package

5/14/2012: Case Complete at NVC!

6/6/2012: NVC Left!!

Beirut Lebanon Consulate

7/11/2012: Interview!!

Result: My husband is put in Administrative processing :(

8/17/2012: Embassy called my husband to bring the pasport for the visa!! :D

He can always try. Odds are you won't get it - because of the one in process (I-130).

They will not stamp his passport with anything if he is denied - where did you hear that? I have never heard of that.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

you can not apply for a tourist visa.

you already have a migration process and will tell you that you have to wait to complete your process.

do not waste your money on getting a tourist visa.

happened to me the same. and the officer told me as I am the wife of an American citizen I have the right to have a green card.

I went to get the tourist VISADES before applying for a green card and was denied.

Of course the US citizen "you" cannot apply for a visa because they don't need one. The foreign spouse certainly CAN "apply" for a tourist visa but the chances are none and none of being approved, because the law forbids granting a tourist visa to people with immigrant intent. They do make exceptions for the rare humanitarian need.

clear that she can apply but you have to be realistic, they will not give TOURIST VISA! you do not confuse it, and do not think that she can give it a tourist visa.

I had that experience and the officer was very clear with me!

any person who already has an I-130 sent to USCIS, CAN NOT GET THE TOURIST VISA.

Why? I asked:

and the officer said that now that I have a file i-130 and I have intentions to migrate to the United States. clear that this is true, I want to be with my husband as fast as possible.

WHY NOT GIVE THE TOURIST VISA. MAY APPLY, BUT WE DO NOT GIVE THE TOURIST VISA.

AND THERE ARE OTHER VISAS AS THE HUMANITARIAN AND IT IS ONLY IN EXTREME CASES AND EMERGENCY.

NO, it is YOU who does not understand. Perhaps it is a language issue but "she" is a US Citizen. US Citizens do not apply for visas, for themselves OR for their spouse. Foreigners apply for visas. "She" is a US Citizen.

Please do not confuse the terms "file a petition" and "apply for a visa". They are not the same activity.

yes, your husband can apply for tourist visa, but they will not give a tourist visa, because he already has agreen card petition.

you can not go to get a tourist visa to your husband, he has to do it alone. but as I say, it is not given.
