This is very unusal to happen. Obviously USCIS didn't received your 129F packet because the check wasnt cashed. All you need to do, Refile asap and tell your fiance not waste another 1 month of waiting for nothing :blink:

November 2, 2010 - NOA 1 hard copy (dated Oct. 29, 2010)

Per the instructions the forms should be sent to TX. Your check would have been cashed before they sent it TO california. I would be resending that paperwork and sending another check. There's no reason that they wouldnt cash your check right away.

I heard of someone sending it to Cali instead of Texas and Cali service center sent it to Texas for them just to have Texas send it back to Cali maybe a one time thing who knows.

ONe thing I notice about people on this site is... they always blaming the USCIS.

I'm a little new to this site, in regards to being a regular user.

My best suspicion (couldn't there be a million scenarios here?) is that

1) someone did a very inept job

2) someone is mis-reporting

3) someone is presenting a hoax

Well, I mean, the poster herself, said: "This has NEVER HAPPENED BEFORE" probably.

Now, I understand,... nothing surprises me, and there's always a first time for everything.

Sometimes, we just simply fail to follow even the most simple and mundane rules, for our own neglect and other-life-distractions.

I am liking this thread....At least its a way to entertain myself since CSC is still not issuing my NOA 2 :innocent:

1) I am at a total loss. It has been over 3 months since my fiance filed the petition in California and we have not received an NOA1. 2) He finally called them last week and the lady said they're backed up and he mentioned something about them 3) not processing petitions that are not standard size? What is that??? I'm sorry to be sounding like I'm ranting here, but let me just say it, I am VERY frustrated!!! 4) We know they haven't received it at all because they didn't charge the check he sent in. Why is this happening? Have any of you ever heard of something like this? I'm ready to wait a long time for NOA1 to NOA2 but to wait this long for Filing to NOA1, it's absurd and so disheartening. :-(

1) NOA1 usually comes within a week.

2) even if they was really backed up it still wouldnt take over 3 month

3) if you sent in a petition that they could not process then it would be returned.

4) if you know they havent received it then why wait another 30 days??

im sorry but i really think you need to ask your fiance about your petition because he has waited 3 months to call them (and even then he obviously hasnt pushed them for answers because they should of at least told him if the petition had been received or not) and now he wants to wait another month before re-filing.

OR you ask him if it was even filed in the first place

Here are the possible scenarios:

1) USC DID really send petition and it got lost. Unusual but it has happened before - but why not be conerned until 90 days has passed?

2) USC DID really send the petition and the check bounced. If that happens, USCIS returns the petition and no NOA1 is ever issued.

3) USC DID NOT send petition. There have been other posts about this happening on VJ and the unfortunate petitioner was strung along for months until ultiimately finding out the truth about the petitioner.

OP-

Your fiance's actions in this case do not make sense. Most of us petitioners are so caught up in this process that we celebrate the little milestones such as NOA1's or a "touch" from USCIS. For him to not exhibit any concern for the status of the petition defies logic and normal thinking. Most of us check the USCIS site daily for updates, or check online here at VJ to follow the processing times of our fellow forum members.

I am not going to insuinate that something is not as it appears here, but I CAN tell you that 99% of us petitioners would be doing SOMETHING after 1-2 weeks of not having received an NOA-1.

I think you and your fiance need to have a long chat about the situation...
