God willing I'll be be leaving to the U.K. soon sometime in Nov and planning on getting married... I wanted to know for those who have applied for the CR-1, After marriage, can I live outside the U.S. legally with my spouse while he does his school in the U.K. and wait for the filing process? And also, I wanted to know what is a good, appropriate time to file after marriage?

Yes you can live anywhere. Just research the visa requirements so that you are prepared regarding sponsorship and US domicile.

If I understand your question, you are asking if it is ok to live outside the US while the CR-1 is being processed? If that is correct then yes it is ok and normal. Only citizens certain countries will be granted a visa to enter the US while the CR-1 petition is being processed. Morocco generally isn't one of those countries. There won't be any problems caused by you living with your spouse in the UK while waiting for the application to be processed and in some respects it will be a plus for establishing the relationship bona fides.

Note that after you have entered the US and received your green card, then living outside the US for extended periods is not allowed without prior approval.

It will be impossible for him to enter the United States while you are petitioning him for any visa. The only way he would be in the United States is if he was already here, you met him, you decided to get married to each other. But that is not the case for you.

Yea I get that, biggrin.gif that's why I would go live with him... I meant when he is finally here he won't be able to leave as long as he wants he would have to ask permission... because his Green Card could expire and that is a big NO NO... blink.gif My question was can I go live with him while I file, they said yes... but thank you for your clarification... smile.gif

Yes, I think it is a good idea to go live with him for a while. Just make sure that you have someone in the US who can receive papers for you, because some things might be time sensitive and you will have to take action, perhaps sending things to the government.

Yes, I think it is a good idea to go live with him for a while. Just make sure that you have someone in the US who can receive papers for you, because some things might be time sensitive and you will have to take action, perhaps sending things to the government.

i was under the impression that theres nothing to stop someone entering under the VWP while there are petitioning for a Visa (admittedly you are not guaranteed entry)but i was still under the impression that there was nothing written to say you cant and many people have ?

You are a USC and live in the US, your soon to be husband is a citizen of Morocco who is in the UK? What visa does he have for the UK? Do you have a visa for the UK?

In order to file from outside the USA for a CR1 you need to be a legal permanent resident in the UK and have been as such for a minimum period of 6 months before you can file.

I believe you will need an address in the US. So maybe a family member you can trust to handle your mail?

And you will probably need a co-sponsor.

Tnx this is all a bit confusing for myself also but I will find out or ask when I get to that step lol It's overwhelming...

Yes I'm a U.S. Citizen and he is has been on a student visa for 2 years and he will soon extend his visa... Once I marry him there with a Marriage Visa, which I have... I want to file for him when it's appropriate to do so... while I live with him there and he can finish his school. I can get a visa as partner of a student living in the U.K. I wasn't sure if I could file for his U.S. visa while we live there... or I had to stay in the U.S. to do this...
