Hi,

On our initial I 129F petition for a K1 fiance we listed my children who will be accompanying me. Does anyone know when we need to apply for the

K2 or will the embassy sort that at the same time as the concluding visa interview? We're pretty certain it's all accounted for by mention of them in the petition, but a couple of websites mention filing and providing birth certificates, permission from the other parent and so on, which we haven't been asked to provide as yet. Any information to put my mind at rest would be gratefully received. The children are under 16years. Thanks :)

Each person must have a visa. You have to file & pay for them just as was done for you. It does appear to people that they do not but they must go thru the same process as the parent.

Permission for the other parent is required. Check with your embassy to find out exactly what they require. The one I am familier with gives out a sample letter if asked.

I can't imagine why we weren't informed of this. I know that we'd need to get them in due course but not to apply at the same time. Do you think this will delay the K1 being issued, or at least delay the chance to actually join my fiance?

We have all the relevant documentation, just not separate visa applications. Its very confusing as many sites say that children can travel with the parent under a K1 so long as a K2 is filed as soon as the K1 is approved and we were never informed differently??!

http://london.usembassy.gov/iv_15.html Your London instructions start here but there are many links to explore. Notice Step One tells you the forms to be completed by each family member. Just you fill out the DS-156K as principle immigrant. All must have documents,passports, immunizations, medical exam, etc.

Under the age of 14 does not have to attend the interview with you.

Believe me we made the same mistake. When we asked USCIS we never got an answer. We figured it out by finding V J. It took us months to get my daughters case approved so we could bring her with us. However our case was a K 3.

You werent informed because there is no one to inform you unless you used a lawyer. Like many people you thought you understood that they would be given a visa as the result of yours. Now you find there is no derivitive status for them. Their petitions should have been filed at the same time as yours but seperatly.

Their status wont directly affect yours so you can interview & get your visa as you wish. You can use the visa but as a K 1 its a single entry visa. You could wait until they have thiers if you think it will be before your ability to enter the USA expires. A friend is your situation asked the embassy to not issue hers & to extend the interview date so the child could come with her. They were happy to that for her. Check with your embassy about the timing of all of this.

Thank you so much for that link. So it would seem we haven't let anything slip by then. For a moment I thought we'd allowed a massive oversight as we named them on the I-129F but made no separate payments or applications. So as far as you are aware no separate applications should have been made as yet for the children?

You are fine. They were listed on the petition. It's not time to apply for visas yet. You are dealing with two separate US government agencies. USCIS approves you to move on to the visa part because you have met in person and are both free to marry.

Then the Dept of State (DOS) takes over because they are over visas and embassies. The hand-off is at the National Visa Center (NVC). You get assigned a new DOS/Embassy case number. London will notify you when they have received your case and it's time to apply for the visas. All they send you is that link...no packets or forms. You can get ahead of the game while you wait by knowing what's coming up. Read all the information and start looking over the forms. Order police certificates, get immunization records and/or needed boosters, have the right kind of birth certificates (with parent names), and get permission from the father to take the children out of the UK. By the time London sends you that link to inform you what to do, you'll already have it done. The visa medical can be scheduled as soon as you have the new case number from NVC and your police certificate(s). That will be after USCIS approves the petition and hands it off to NVC.

Permission from the father can be a simple statement saying he grants his permission signed in front of a solicitor. Include everybody's full names, including his, so it sounds complete. If you have sole custody, then court documents showing that will do without his permission.

You are fine. They were listed on the petition. It's not time to apply for visas yet. You are dealing with two separate US government agencies. USCIS approves you to move on to the visa part because you have met in person and are both free to marry.

Nick, you don't know what a relief it is to read this! My fiance called USCIS yesterday and they also said children of K1 parents get derivative status so no application need be made at the same time.

As for the certs, I m onto it and have them all already. Just need to go to my solicitor and have a hard copy letter sent saying the father signed a release letter and the other one couldn't even be bothered to reply within the time frame :/ Or at all! Hopefully a solicitors draft to this effect wil be enough. Can't thank you enough for this ost :)

I think it will be fine. I keep up with the London stories and a woman interviewed some months back with nothing because she couldn't even find the father. They just pulled out an affidavit for her to sign swearing that there were no pending custody disputes over the children or something to that effect.

Thanks to everyone who answered. The mebassy confirmed that my I129F gives them derivative status and there is nothing we need to do yet. Phew!!

On the 129f form you list ALL the beneficiary's children, whether they all will be given K-2s or not. You list ALL of them.

Then on the DS-156K or whatever form your Embassy uses, you list only those that will be given a K-2. This form is brought to the interview. Very simple.

Yes, you need notarized permission from the other parent for the child to immigrate permanently to the US, you need the BCs and each will have their own medical.

Thanks everyone for your time and help. The embassy verified they do have derivative status so will get their K2's if/when My K1 is issued. I was very worried there for a moment thinking they needed separate alicatiosn made at the same time as mine!!
