Ok. Another question...

My husband's income is very low for 2010 ( like $7000). And he did not file taxes for previous 2 years ( did not make enough). In section 25 he will state 2010 number , but nothing to put in 2009 and 2008 . If he will leave these lines blank or n/a , will we get an RFE? Of cause we are using a Joint sponsor with very good income,will send her 3 years of tax returns. May be my thoughts are a bit confusing... All in all, in case of using a Joint sponsor who has 3 year tax returnes with ~$90 000 income and I-864 of my husband with only 2010 very low tax returnes and empty lines for 2009/2008? What are the chances?

09/04/2011- got married

10/18/2011(day 0)- mailed AOS package to Chicago Lock box via USPS Express

10/19/2011(day 1)- packaged delivered

10/21/2011(day 3) - received email notification

10/24/2011(day 5)- Checks Cashed ($1490)

10/25/2011(day 6)- Hard Copy of NOA1 ( I-130,I-485,I-765)

10/29/2011(day 10)-Biometrics letter for 11/10/2011 11.00 a.m

11/01/2011----------Got my Drivers License with NOA1 ( for 1 year) :)

11/10/2011(day 23)-Biometrics done for I-765/I-485

12/16/2011- EAD production notice

12/21 & 12/22 - again EAD production/approval notice ( I guess it's mailed out)

12/24/2011- EAD card in hand

02/22/2012- Update on USCIC.com- interview scheduled for March 26th

Ok. Another question...

You will want his form as complete as possible. You could write "did not file" on the years he didn't. And if you read the instructions it says if you did not file to include a statement saying why not. He would give the amount he did earn and they will know the threshold required for filing. They have lists. Example: I did not file a tax return in 2008 because I earned $527 so was not required to file.

So, Put " did not file"? where to put the amount he did earn, in the same line? and what do you meann by " they have lists"?

The next blanks are to be taken straight from a tax return

"My total income as reported on my Federal tax returns for the most recent three years was:"

He has no tax return so can't report income off a tax return except for 2010

2010 - $7000 (get it exactly off the tax return)

2009 - leave it blank

2008 - leave it blank

(I pulled up a form and it won't take anything but numbers so you can't put did not file unless you wrote it in by had after printing)

So now that there are two years with no tax return income, he has to write an explanation about those years of not filing. He can't just say I didn't make enough. He should say what he made. Each year tax laws change. In 2010 if if single and you made over $9350, you had to file. In 2008 & 2009 it could have been a different amount. He could research the irs.gov website for previous years and quote those amounts. But I have read on USCIS website that it is not necessary to look up those numbers because the adjudicators have a chart to refer to that gives them the minumum filing requirement. So if his statement said I did not file because my income was $9021 in 2010, they would look at their list and see income under $9350 didn't have to file. That would be an acceptable reason for not filing. Another acceptable statement is I was unemployed in 2009 and made $0.00 income, so did not file a tax return. It is also more specific that "I didn't make enough".

Thank you, Nick-Nick. I will do so. I actually called an immigration attorney that gives free consultation over the phone and he told me basically the same thing: do not check the box, put only 2010 income number and attache an explanation. ( or hope for the best :)

Now we have to figure out if he had to pay hid 2009/8 taxes. for 2009 he made like $4000 and was receiving food stamps. May be I should include a letter of him receiving food stamps or i wouldn't be a good idea?
