Hi everyone,

I'm filing for a CR1. I'm French and my husband is American.

I have a child, in France, 10 years old who lives with me part time and with her dad.

Do I need any paper work (full costidy, or anything else) for my child in order to file the CR1? Or, can I begin filing, then once it is on its way, work here in France for the full costidy and the right for me to leave with my kid for America? I think showing to the French juge that I already began filing for the visa is gonna help instead of trying to obtain full costidy in order to leave before, saying that I will after...

Can anybody help me?

If your child is going to be moving to the US with you, there is no automatic derivative visa for your child in your case. Since your marriage to your USC husband occurred prior to your child's 18th birthday, your husband can file a petition for your child to receive a CR-2 visa.

I'm certain the Embassy will require paperwork showing that you have the authority to take the child to the US before the Embassy will issue a visa to your child.

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I have a child also 10 years old, and since the father did not approve his departure to the US, I had to go in front of the judge (JAF) to obtain the authorization.

The consulate requires at the time of the interview, an approval letter from the other parent SAYING THAT HE ALLOWS HIS CHILD TO LEAVE THE COUNTRY AND TO ESTABLISHED WITH THE MOM IN THE US or a judge decision to be able to deliver the visa k1, I am sure its the same for yours.

After 1 year and 5 months I got approved (one RFE and a letter 1 year ago of a potential waiver interview)

Yes Matylda, show the judge that you are already in the process and give him a date of establishment, you have to tell him also that you need this decision before your interview in order to be able to get your visa.
