I am the petitioner for my spouse. My current income is foreign income so I am not able to sponsor her on my own.

My Father is going to be the joint-sponsor. He files a joint tax return with my Mother. Her income is not needed to meet the 125% above poverty income requirement.

When filling out the I-864 Affidavit of Support form, my Father has included only his income on line 23 of the form. He has IRS tax transcripts for the last three years, but since he files a joint return the transcripts include both his and my Mother's income. On line 25 of the I-864 should he enter, total income exactly as shown on the transcript, or total income as shown on the tax transcript minus my Mother's income (her income is a very negligible amount)?

You have 2 options.

i) You will need to send I-864A of your mother and include her income also.

ii) Just use your fathers income and attach copies of his W-2s to match amounts entered, as the IRS transcripts do not differentiate their separate incomes.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Do the W2's need to be originals or are photocopies fine? If they need to be originals, will I get them back?

Submit copies of anything unless an original is specified. It is always a good idea to bring originals to the interview in case the officer would like to inspect the original and/or compare it to the copy.
