Does CSPA Applies to my case?

Hi everyoen,

My father ,who is a IR5 GC holder (A son of a US Citizen - My brother), filed a I-130 Priority date 08/09/2010, approved on 01/07/2011 and case complete at NVC in 02/25/2011. My DOB is 11/16/1990 and I will be 21 years old on 11/16/2011. Since my priority date is not current, does anyone know

if I will be eligible for CSPA? any help is appreciated. Thanks.

If your priority date becomes current before next May then you'd qualify for an F2A. Otherwise, you'll be waiting for an F2B.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

It took USCIS about 5 months to approve the petition. This means that the beneficiary has an extra 5 months after age 21 before aging out. If your PD becomes current by the April 2012 Visa Bulletin, your CSPA age will be under 21 and CSPA will help you remain in the F2a family preference category. If your PD is not current by the April 2012 Visa Bulletin, your CSPA age will be over 21 and you will age out into the F2b family preference category.
