hello everyone,

my bf and i haven't seen each other since i was 7 months preg. our son is now 2.we are applying for the k1 visa and i have to write a letter explaining why we haven't been able to see each other in the last 2 years. he talk several times a week and his mother lives with me. we haven't been able to see each other in person due to financial problems (cost a lot to get passports and tickets to phillippines with a 2 yr old)any advice would be greatly appreciated.

It is very unlikely that you will get approved without having met in the last 2 years. It's very difficult to prove that you're unable to meet. A letter explaining that you can't afford a passport, unfortunately, will not do anything for you.

Hopefully someone else will have some answers as to how you should proceed. I'm not sure having a child together really changes anything about the 2 year meeting requirement, but I doubt it.

I believe the 2yr requirement for a K1 is a firm requirement.

A question that comes to my mind...

If he can't afford to make a trip there. Does he make enough to qualify without a sponsor?

I would suggest you contact your state senators office "Immigration Section" to discuss options. If you file for the

K1 and it is denied. I think the filing fee will be forfeited.

They will deny the petition based on the fact that you two haven't met up in person within the last two years before the filing of the petition. Financial hardships are not given much weight in the manner. You don't have to meet in the Phils; you can meet somewhere else as long as both of you are there; the child doesn't have to be there also.

You have to prove extreme hardship in order to be exempted from the 2 yr rule but financial hardship? The K1 process is pretty expensive, if you find getting a passport pricey, what more the rest of the expenses (medical, visa fee, AOS??? :wacko: ). I hope you'll be together soon. :)

11/1/11 - AOS package Delivered

11/7/11 - NOA Received in the mail

11/12/11 - Biometrics Appointment received

11/28/11 - Case transferred to CSC

12/7/11 - Biometrics done

1/2/12 - EAD and AP approved (Card production)

1/11/12 - EAD/AP Card received

1/20/12 - Got Driver's License!

3/7/12 - GC approved!

3/9/12 - Got a job!

3/11/12 - GC on hand
