My Canadain cousin found out in FOIA 212(a)(7)(A)(i)(I). He sent back to Canada.

Now we need to know what next. Does he need to apply for waiver or its just refused entry and he can try again as visitor.

? More information please. How and why was your cousin trying to enter the US? Was it for tourist visit or some other reason?

basically, a 212 means you're not admissible into the US. 7aiI means that you did not have Documentation Requirement for Immigrants. Did he say something at the border about "moving" or "living" in the US. If it was over 6 months or 180 days then he needs a visa.

You must apply for a I-212 waiver before he can try to enter the US again.

DO NOT try again without apply for the waiver. There can be jail time involved or a more lengthy time period to wait before you can try to re-enter.

Give us more info:

Was he charged with fraud?

Did he previously over stay a visit??

Thanks guys for quick response. He was unlawful presence in US 8 years ago for more then 180 days and got VD.

He was seeking entry as few hours trip at POE and got refusal because of 8 years violation. He is Canadian citizen and doesn't need a B1/B2.

If he need I-212 waiver does it gonna solve the problem ? or he need to apply for I-192 as well ?.
