Wow,thank you all!It is at least clear now about alot of things.Its going to be a rough road Im sure of that.She has never been back to Mexico since she first got here,until now.She never has had any problems or contact,so my thinking is at least she dont have any illegal entries except the first one many years ago.If we have to send here back to Juarez to adjust,cant we say that's what she is doing?I know she went to bury her father,but if we use this time to file all paperwork,wouldn't that be doing the right thing in there eyes?

The time consumer will be the I130 waiting time. Start preparing your hardship info now so you'll be ahead of the curve. If it was like our 130 interview she was denied then and told to get the I601 prepared. I think Juarez has almost immediate adjudication of the 601 so you have but one shot. I was told by our lawyer that it takes about two additional years and lots of $$$$$ to appeal a denied 601. READ, READ,READ and then research some more. The 601 will cost $585 so start saving up.

Lots of chatter here, but frankly without very specific time lines of her entries and exits including her age at each step along the way, there is no easy way to give advice. But one is for sure--she has a ban, and the only question is how long, and is it waivable immediately or is there a waiting period. For example, there are lifetime bans that are not waivable and others that are waivable after ten years...I'd also suggest going to www.immigrate2us.net where they handle these types of cases--and much worse every day.
