Hi,

I have a question, my mother-in-law came from Russia to stay with us for 6 months to help with our newborn baby. She does not speak any English. She came on B1 visitor visa through Atlanta POE. At the POE the officer stapled I-94 into her passport and then she proceeded to her connecting flight to Pensacola. While boarding the connecting flight, Delta person at the gate removed I-94 from her passport. I have no idea why. My mother-in-law could not ask him, and she tried to get her I-94 back from him, but he signaled to her that she does not need it and she needs to proceed into the plane.

At this point I am trying to figure out how to get a replacement I-94 for her so she can submit it at the time she goes back to Russia. We don't what her to have problems getting her visa next time. I can file I-102 with USCIS, but I really hate to pay $330.00 as it is not our fault that somebody was stupid and removed I-94 from her passport. It's been about 8 weeks since she came and she is staying until January. Should we try to call Atlanta POE?

Try calling and see if you can get any answers from them.

The only other option is paying the fee.

I had to do that...and the process took about 4 months.

03/13/2011: Got married! <3
06/06/2011: Mailed packet included I-130, I-485, and I-765.
09/16/2011: Green Card Received!

11/19/2013: Approved! Card Production.
