First of all, I would like to thank all the people that have given me answers on my questions. I really appreciate it and you have made me feel a lot more confident. I have not started petitioning anything yet but I am trying to gather as much information as I can for the future if I need to petition for a K-1.

My questions:

1. Does the sponsor need to make the annual requirement before taxes or after taxes?

2. On the guides, it says that if there are no co-sponsors and the American fiance doesn't meet the financial requirements, both fiances must send in evidence of income. Is this true because all I've heard was that I will need a co-sponsor if my fiance cannot meet the financial requirements at the time.

3. If there are more than 1 co-sponsor, does that mean the wage of both co-sponsors are considered added together?

For example, if a sponsor needs to make 18,500/year for a household of 2, and I get 2 co-sponsors, 1 earning $15,000 and the other earning $16,000 and they both sign the Affidavit of Support, is it considered $31,000 a year or are they both ineligible?

First of all, aren't you the beneficiary... the non-USC fiance? If so, you will not start petitioning anything. You can gather all the info you want, but really it is the USC that has to gather all the info and he is the petitioner.

Now to your questions..

1) Before taxes

2) If your fiance cannot meet the financial requirement he will need a co-sponsor.

3) Not sure about that one. someone will come along shortly. Hold a gun to my head and I would say that a co-sponsor would have to meet the entire requirement. on the other hand, what would be the point of having 2 co-sponsors if that is the case. I do know that if your fiance is short of the required amount he can't get a co-sponsor to make up the difference. I.e. The co-sponosor has to make enough to support his family and YOU all by himself (can't add it to your fiance's income).

Lastly, even if he finds a co-sponsor that meets the minimum requirement, it doesn't mean the visa will be approved. The minimum requirement is the minimum to get approved. I.e. If he, nor a co-sponsor meets the minimum then the visa will not be approved. That does not mean that if he or the co-sponsor meets the minimum then the visa will be approved. It's up to the CO doing the interview if he wants to approve the visa or not.

No, unfortunately that's not the case!

Oh I see. I was hoping the income would somehow be added together so it would be a little easier for my boyfriend. Thank you for the answers.
