Hello everyone I am new to this forum and I am looking for advice in regard of requesting a K1 Visa or DCF if marry abroad, this is my situation, my fiancee lives in Ukraine and I live in Washington state, we would love to get marry in the Caribbean this year but I know the K1 Visa takes about 5 months to get it, so If we decide to get marry Before December and I move to Ukraine to live with her for 3 months could I apply for DCF and get a K3 visa instead?

Short answer is no.

DCF is for the CR-1 spousal visa (forget the K3), but you need to reside abroad for 6 months, not 3, and the Ukraine has no USCIS office so as of last week, DCF is not an option for those living there. How about getting married in the Ukraine, filing for the spousal visa CR-1 via the normal channels, then jetting off for a honey moon in the Caribbean? Or the other way around file for K1, when she gets it marry in the USA, Adjust Status, then a few months later have a delayed honeymoon (and religious ceremony if you wish) in the Caribbean. BTW, it is extremely unlikely you get a K1 in 5 months- 8-10 months is more realistic for the K1, with 9-12 for the CR-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello, thanks for the info, So if I got marry in the Caribbean, then can I file for CR-1 visa while I'm living in the Ukraine? how long would usually this process take? do I still need to live abroad the 6 month period to do get the CR-1?

Yes, you can file for the CR-1 visa as soon as you have the marriage cert. You can live whereever you want, but must have a US mailing address they can send stuff to-a friend or family member that can forward things to you. How long the process takes depends on which service center you file through and how quickly your local US embassy issues interviews, but usually 9-12 months from start to finish; she then has 6 months to use the visa. You do not need to live abroad at all to file.
