Hi,

I got married this past July to my boyfriend of 3 years who is a US citizen. I am planning to file in early Septemeber. We don't have money to pay for a lawyers services so we have been filling out the papers by ourselves. However, I have a few questions and hope that you guys will be able to help me out.

1) This might be a silly question, but on the I-864 Affidavit of Support when it asks for current individual annual income (#23)is this the income before expenses and taxes have been deducted? that is is it the figure reported on the line "Wages, tips, salaries etc" (which is line 7 on the form 1040) or do we use line 22 on the 1040 which is the amount after deductions?

Also if his mother decides to be a COSPONSOR she has to fill out form I-864A as a household member whose income will be used to support me also. However, she filed taxes jointly with her husband so would he also have to fill out a I-864A?

2)On my form I-765 do I check Renewal of my permission to accept employment since I had been issued a work permit for OPT in 2009 which expired in 2010?

3)on Form I-130 Section C (information about your alien relative). It says list husband/wife and all children of your relative. Just to be clear: would my husband just list himself in this section? since he is my husband and i am the relative?

4)On Form I-130 section C #22 Do i put the USCIS office closest to me even though the package is being mailed to the Chicago lockbox?

5)on FOrm G325A Biographic Information in the last box it says Applicant :print your name and Alien Registration number. So for the G325A that my husband fills out whose name does he put in that box since I am the applicant, not him...Or does he just put his name?

I know these are alot of questions but any help would be greatly appreciated.

how are you still in the US if your OPT expired in 2010? are you back in school because if not you may have problem adjusting your status.

Overstay is irrelevant/forgiven for spouses of USCs, so no, she won;t have a problem because of that.

OP: To answer you questions:

1. You use total income. Mother should fill out I-864 as well. It's easier that way, though she will need to qualify on her own. If you absolutely must add the incomes in order to qualify, get back to us.

2. "Permission to accept" it's not a renewal because it is in a new category.

3. Yes.

4. People either put the local office or the lockbox. I am not sure what is correct, though no one has had problems. They will fix a minor error like that.

5. He can put your name too or leave it blank. He shouldn't put his name because is not an applicant for anything.
