Timeline

My wife entered on a K1 and we married in the 90 days. We are now filing an for AOS and elected to use a visa service. This service is insisting that we must file an I 130 either before the AOS or with the AOS.

Has anyone else done this?

Day 3 3/02/05 TSC received

Day 5 3/04/05 Mail confirmation of delivery

Day 11 3/10/05 CSC received trans I129F

Day 16 3/14/05 Check cashed (WAC #)

Day 17 3/15/05 NOA-01 issued

Day 18 3/16/05 NOA-01 received by mail

Day 32 3/30/05 NOA2 online approval!!!

Day 37 4/4/05 NOA2 snell mail

Day 37 4/4/05 NVC receives application

Day 40 4/7/05 NVC number by E-mail, application forwarded to Bogota WOW!!

Day 44 4/11/05 Snell mail approval from NVC

Day 52 4/19/05 Embassy receives App.

Day 56 4/23/05 packet 3 received

Day 66 5/03/05 packet 3 faxed to Embassy

Expect June interview! Did not happen!!

6/07/05 Finally Packet 4

7/07/05 Interview date

VISA RECEIVED 7/13/05

TOGETHER WE ARRIVE IN AMERICA

7/15/05

MARRIED: 08/05/05

8/11/05 return from honeymoon in N.O.

05/01/2006 Biometrics Appt.

07/12/2006 AOS Interview APPROVED

07/24/2006 GC arrived

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail

Surprise, Got my answer off the USCIS website.

Fiance(e)

You were a fiancé who was admitted to the United States on a K-1 visa and then married the U.S. citizen who applied for the K-1 visa for you. (If you married the U.S. citizen but not within the 90-day time limit, your spouse also must now file USCIS Form I-130, Petition for Alien Relative ). Your unmarried, minor children are also eligible for adjustment of status. See How Do I Bring My Fiancé to the United States? for more information. If you did not marry the U.S. citizen who filed the K-1 petition in your behalf, or if you married another U.S. citizen or lawful permanent resident, you are not eligible to adjust status in the United States.
