k1 under Administrative Review. What if we get married here in the Phils. instread?

Can any one help us here?

Me and my fiance was place on an Administrative Review.

Below is my info:

INTERVIEW DATE: 7/15/2011

-Put on Administrative review

Called 02 301 2000 and asked if I could changed address coz im moving back to the province while waiting but the lady said that it is not possible.

Called again and they say that usually it will take unto 60 days for the administrative review process.

So, me and my fiance are planning to get married here in the Philippines Instead of waiting for the result coz we don't know if we are to wait until forever or what not.

We are so frustrated with this "no time line" procedure that they have.

Does any one knew someone who applied for K1 visa but still getting married in the Philippines?

Please help us, we need feed backs.

If you get married now you will have to start the process all over again as K1 visas are only for fiance(e)s, which you will no longer be.

You will be looking at around 8-10mths to have an CR-1 visa processed, and I believe that getting married is no guarantee that you will not be placed into AR again the second time around.

If it were me, I would be sitting tight for a bit longer to see what comes of the AR, but of course it is your decision.

1 Dec 2010 - I-130 received at Chicago

18 Apr 2011 - APPROVED!! NOA2 text and email

NVC

29 Apr 2011 - Case entered into the system/Case number assigned; Medical Exam in Sydney

30 Apr 2011 - Police Check Application sent

2 May 2011 - Called NVC and got Invoice ID number

3 May 2011 - Sent DS-3032 email

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

24 May 2011 - Received Police Certificate after 25 days (so much for 7-10!); IV package sent

27 May 2011 - IV package delivered according to tracking

8 Jun 2011 - RFE for original marriage certificate; requested supervisor review since we KNOW it was in the package!

30 Jun 2011 - SIF and CC - FINALLY!!!!

13 Jul 2011 - Interview date assigned! Scheduled for August 9th @ 10am

9 Aug 2011 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!

12 Aug 2011 - Visa in hand

24 Aug 2011 - POE @ LAX

Yes, people sometimes get married during the K1 process because they are tired of waiting, or realise they want to get married in the foreign beneficieries country, not the USA. But this voids the whole K1 process. You will have lost the fees, time and effort you have put in and need to start from scratch with a CR-1 spousal visa. It will be more of a wait, not less.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What exactly were you told regarding the administrative review? Did they give you your passport back? Is your case relatively

simple, meaning, no red flags with your petition?

I would hold off for a couple of more months before you switch over to CR-1. That is a whole other process and fees you have to go through and like the previous poster stated, there is no guarantee that they won't put you on administrative review again.
