Hi Everyone,

I recently received NOA 2 for I-130 and I-129F (spouse) together from CSC. This case is for my wife who is in India. My case now is in process of being transferred to NVC. I have few questions and I'm hoping someone who has been thru this process recently can help me.

1. Does my I-129F application automatically closes due to recent rules set up by USCIS?

2. How long does it generally takes to

Reading about the list of documents I will be submitting on this forum I understand that I am required to submit several documents (e.g: Marriage certificate, birth certificates) but do they have to be original or can I submit copies (notarized). My friend submitted all notarized copies but was required to show original documents in Delhi Embassy during his wife's interview. Would like to know if someone did the same. I am in US and I will have to find someone who can help me get originals/ duplicate copies.

Please feel free to share any other information that I should know. Also, any tips on making this process quick and pain free will be greatly appreciated.

That's an NVC policy and the NVC is under the purview of the State Department. That policy was implemented in February 2010. The I-129F will be administratively closed if it arrives at the NVC at the same time or after the I-130. If the I-129F arrives at the NVC first, it will be assigned a case number and sent to the Embassy in New Delhi or one of the Consulates, this is based on where in India your wife lives. Should the I-129F for K3 go forward, you will still have a choice, if you want to pursue the K3, follow all the mailings received from the Embassy or Consulate, if you want to pursue the CR-1, follow all NVC processing steps.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I was in a similar situation - the NVC closes out the I-129F in favor of the I-130, since this is the more powerful and appropriate visa category (the 129F is a temporary non-immigrant visa anyway). So most likely, the 129F will be closed and only the 130 will proceed (btw, this is exactly the outcome that you want anyway, as it is a royal pain to get the K3 converted to a green card; there is no such hassle w/ the 130). So basically dont worry about it. your 130 will proceed.

as for docs required, you have to send originals - no choice here. Make photocopies (ie scan in everything) so that you have records. but dont worry, you'll get it all back when you go to the interview. You could go w/ what your friend did, but IMO, why take a chance and risk getting an RFE? Although I dont understand when you say you will need someone's help - you should already have your original marriage and birth certs. for me I got lucky here, as when my wife and I got married, we actually got 2 copies of original marriage certificate; so sending one was not a problem for me. But in anycase, we got all our originals back fine, so its ok. do write your case study on the top right/left of EACH document AND page in case there is some document mix up or misplacement, so that they can reunite it w/ your file if something does happen.

NVC:
04-29-2010: INTERVIEW ASSIGNED FOR JUNE 10TH IN CHENNAI CONSULATE, INDIA; 06-10-2010: INTERVIEW - VISA APPROVED!!!!!
06-18-2010: Entered US - NEW YORK CITY and 08-16-2010: GC received! (nearly 2 months after PoE) woo hoo!
AOS for permanent 10 yr green card:

04-02-2012: NOA of I-751 and 1 yr extension of temp green card

05-03-2012: Biometrics appointment

12-18-2012: 10 yr Green card approved; 12-22-2012: Green card rec'd

N-400 citizenship:

06-19-2013: N-400 mailed; 06-22-2013: N-400 rec'd at Dallas lockbox

10-3-2013: Interview date - APPROVED!

10-18-2013: NATURALIZED - We are done with USCIS!!!
