Well I am a US citizen and my fiance is Mexican. I have been living down here in Mexico with him (only on a tourist visa).

We hired a Mexican/American Attorney. She told us she submitted the whole package Around the end of May 2011. We also submitted the other form that we will

get the notification in Email and US Cell phone text..

It is already July 18 and have not received anything from the USCIS. She tells me they are backlogged... but for 2 months?

Is this a little fishy or could it really be possible that they just haven't gotten to my package yet?

I also have another question, my fiance changes jobs alot usually staying at a job for about 5-6 months and changing. He's a waiter. The attorney told us

it shouldn't be a problem and she will email them if he changed again. Well after she sent the package he changed to another job, and now she's saying its

going to be a pain and that she might have to request to have the package sent back so she can redo it?

Whats the deal with this? Is it a big deal to notify them that a job isn't valid anymore.

Wait, so you haven't even received a NOA1 yet? Was the check cashed? Anything? If that's the case, it's definitely fishy. You should receive your NOA1 (via text and email) around 3-10 tops after they receive your package.

Do you have an address in the US where the NOA1 was supposed to be sent to..?

Wait, so you haven't even received a NOA1 yet? Was the check cashed? Anything? If that's the case, it's definitely fishy. You should receive your NOA1 (via text and email) around 3-10 tops after they receive your package.

Do you have an address in the US where the NOA1 was supposed to be sent to..?

Thanks for the reply. My attorney is the one who handled it all, I have been asking for proof of the tracking number and company she sent the package off with and she just doesn't give me an answer of what it is. Then she tells me I have to be more patient because they are backlogged. I wish the easiest thing to do was to get rid of her, and find someone new but money is a big effect right now and I dont know if she is telling the truth or not.

She also would have written a check I suppose when she sent it in, but I have no info on that either.

it does not take 2 months to get noa1 in fact the official word from uscis is to contact themm after 4 weeks if u have'nt received notification. so go on their website get the contact # and call them...

secondly unless he lives at his jobs uscis does not need to knoww abt job change.they need to know if mailing/residential address has been changed not jobs...

The address it was suppose to be sent to was the LockBox in Lewisville Texas I believe.

it does not take 2 months to get noa1 in fact the official word from uscis is to contact themm after 4 weeks if u have'nt received notification. so go on their website get the contact # and call them...

Okay he doesn't live at his job, he just quit and found another job. We gave her the new info on it and she said I usually have the package sent back to me so I can give them the correct information so they do not deny him for incorrect information.

Ok, something is definitely very off. Yes, USCIS is backlogged but with issuing the actual approvals (NOA2) and NOT with the NOA1. That you should have received in under 10 days after submitting the petition. Also, did you not give your lawyer money for the check, the 340$ filing fee for the I-129F? Did she never mention anything of the sort? Something is definitely fishy if she refuses to give you straight answers and USCIS can't find your name in the system. I think you should consider filing yourself, is there a reason you have decided to file through a lawyer? Because it sounds to me as if that "lawyer" never actually filed a petition...

This part right there also makes me think the lawyer has no idea what she's talking about. She can't "request" for a petition to be sent back to correct info on it. If something is missing etc. they will issue an RFE and then you can provide information, but I doubt this'll be a problem and you can just provide the new information on the job on the I-134 at the interview stage.

I agree with the other posts that it sounds like your lawyer is screwing with you.. The first thing you need to do is educate yourself on the process, read the guides here on VJ, ask questions if you have them and then go back to the lawyer with your information and ask them what is going on. If they cannot provide you answers, or tells you information that you know to be incorrect you can fire them, and continue the process yourself, or hire someone else if you'd prefer. I hired a lawyer but after a few weeks realized that VJ was a better source of information and through the rest of the process basically did everything myself.

As far as the fact that he changed jobs after you filed the petition. That's not a big deal... you don't need to get the petition back to correct the information. At the time of filing you were providing accurate information.

When you fill out the forms to make the interview in Ciudad Juarez they'll have you fill out more paperwork asking about job history, you can disclose the new job on that form.

your lawyer is a big fat liar, she is screwing you, it's all lies she's been telling you.my thoughts to you is to forget her and start over filing your petition. you don't need a lawyer, all the info you need is right on this site, and anything you are unsure of you can ask. after you submit your petition, you will recieve your noa1 within two weeks, and you will be able to trace your check and see when it is cash. it makes no sense you sit there waiting, you r not gonna get any where. uscis does not care about your bf jobs, he is the benificiary, they care about if you make enough to meet the poverty guidelines.and don't wait around for this lawyer to refund your cash, you're not gon get it back.

You do not need a lawyer. Most people here file on their own. Read this guide so you know exactly what the process entails: http://www.visajourney.com/content/k1guide

It does not take 2 months to have your check cashed and receive a notice of receipt (NOA1). That will happen really quickly. It is one of the only fast steps in the whole process. This is not where the backlog is. The backlog is in actually adjudicating the cases, and people receiving their approval notices (NOA2). That step can take on average 3-6 months. Not the simple step of the USCIS cashing your check and sending you a receipt for it.

You would have needed to pay $340 for the petition fee, and a lawyer cannot request a file to be sent back to them for corrections. Besides the fact that no correction to the G-325A were needed. You put where he worked at the time of 'filing'. As another poster said, there will be more forms down the line in which he will fill out his current place of employment. I am fairly certain you have no pending petition on file because one was never actually filed to begin with. It sounds like the lawyer has no real clue of how the immigration process for a K-1 actually works, and that they just wanted to lie and take your money. You might want to ask for your money back, since the services you paid her for were not rendered.

Why pay a lawyer that won't even answer your simple basic questions? Read the guides, gather what you need, and mail it in yourself. You can always ask questions here on VJ if you get stumped anywhere in the process. People here are very helpful.
