Hi,

My wife arrived here on April 13th, 2011 and we were married on June 24th, 2011. We filed for AOS on July 5th 2011 and have a certified mail return receipt for July 8th 2011.

Several Questions:

1) Her visa (K-1) expires July 8th, 2011. I assume the AOS will take precedent over that.

2) Her I-94 expires on July 12th, 2011. I Assume the AOS will take precedent over that.

3) When filing the I-485, I asked her for her birth certificate to make copies, but was greeted with "I gave that to the Consulate". After numerous attempts to tell her to never give the Consulate originals of anything, but show them originals when asked for them, she gave them the original birth certificate and it's translation. After our long journey, I can't blame her, she still has copies of the Hukou.

We went ahead and filed the I-485, because of the timliness of the other visa deadline and I-94 deadline. We've been out-of-town meeting family members in another state. Is there someting I should be doing? Is copies of the Hukou enough? Should I ask for copies of her birth certificate (certified) from GuangZhou to be forwarded here. Anything else I should be woried about I haven't thought of?

1. The K-1 already expired on entry. It is ONE TIME use only. Expired after use.

2. Yes

3. You will likely get an RFE for the missing birth certificate. Best to get extra copys of this asap.

Better to get one. You will need it for various things. They asked to see mine when I applied for SSN to verify my name and parents names

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Did you include a photocopy of the birth certificate white book with I-485 submittal ?

Usually they want the original for this,

can get another white book; rather, can any of her family members (listed in her hukuo book) get her a new one, this week? Suggest they get one, send it asap to her, as I think yer gonna get an RFE in a bit.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Yep, her mum or dad can go get her another copy and have it sent asap. Do as Darnell says so you will have it ready when your RFE arrives. :thumbs:

My wife didn't have her birth certificate either when we filed for AOS. It was most likely in the sealed envelope turned in at the airport and they didn't return it.

We got a copy of it resent electronically by her family, printed it and sent it in with the packet. We didn't get an RFE.

You'd figure they'd reuse what's on file, but then it would be too easy.

Be sure to get it ready though, like the others said you'll probably get an RFE if you didn't at least send a copy.
