Hello,

I'm not sure if I need to be concerned about this so I will ask. Looking a bit down the line for our cr-1 petition I asked my wife if she can bring me her birth certificate, however, I was met with a blank stare on her face. As it would turn out she doesn't have and was never issued a birth certificate, even at her birth. She is a Chinese citizen. Will this be a problem for us or does GUZ not require a birth certificate but need her Hukou? Thank you.

no, alas - NVC and GUZ IV need to see her birth certificate,

specifically the white book 'notarial translation' version of it.

Millions of Chinese ppl not have a birth certificate, it is sufficient to simply have entry in hukuo book for family, and that's it.

To get a chinese birth certificate, she needs to get into the ____(something) office in the city or province where her hukuo is registered (a family member in the hukuo book can do this for her, as well.

Then she needs to get the translation done.

For a spousal visa, need 3 white books by NVC time:

1. marriage certificate

2. her birth certificate

3. police clearance certificate

and must include the white book photocopy of the marriage cert when filing the I-130 petition.

Other errata -

if using NVC EP - she can send you scans of the white books, she'll show the originals on interview day

Hukuo is never presented at GUZ IV for spousal visa cases, though sometimes can be shown as evidence if any issue on child foster or child 'ownership'.

Is big possibility she not live in her hukuo city or province, she'll need to get a family member to handle this, one who lives there

Her birth certificate not required for I-130 filing..
