Timeline

we sent our I-129F last June 4, 2011 and we are glad we received our NOA1 on June 9, 2011 but on June 11, 2011 we found out that i am pregnant... well we call it our un expected souvenier from our my fiance's vacation last May 2011.. but that's where our lots of questions and some worries started... its not because of the baby but its because of the papers, we have been looking at the ussual timeline of NOA2 takes 5 months or more... our worries are 1.) my fiance is worried about me being pregnant without by myside, 2.) what if the NOA2 will take more than 5 months, we are afraid that the airline company's will not allow me to fly when my tummy is i think 5 or 6 months old already. 3.) if worst get worst i will give birth here in the Phils, of which my fiance don't really like it plus i heard that the visa will expire in 3 months if i will not fly by then? how true is that? anybody have any idea if we can request to expedite our NOA2 because of my situation?...

No you have 6 months to use the visa from the date of issuance not 3.

You will need to file CRBA and get a US passport for the baby before it can leave too.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

First of all, congratulations! :)

But I'm afraid USCIS won't see pregnancy as a good enough reason for expeditious processing. Haven't heard of it at least. I assume you are already 6-8 weeks along if you last saw your fiance in May, add the more or less 5 months until NOA2 you'll already be in your 3rd trimester and then it will still be an additional couple of months until you have your interview at the Consulate. I doubt you will be able to fly to the US visa in hand before the baby comes. I'm sorry.

But after you have the visa, it is valid for 6 months, so you have plenty of time to fly to the US.

Plus during the exam , she has to undergo x-ray, regardless if she is pregnant or not, everyone is required to undergo x-ray.

if your pregnant you do not have to undergo the xray this can be done at a later date

hi thanks for the reply, we are still hoping for the fast release of our NOA2, we saw some of timelines here it only take 3 months for them to wait for there NOA2 from the receipt of there NOA1... we will just continue to pray though. but at least the visa is valid till 6 months is already a good news.. thank you...

hi ruizlol,

my fiance is in the same boat as yours, (actually I posted a similar question here in the past). it is a RACE between the USCIS and the baby - one you are hoping the USCIS will win. well, tell you what, USCIS in the summer months move expeditiously so there is a GREAT chance that you may get your NOA2 sooner. we got ours in i think 106 days or so. just tell your fiance to start getting ready NOW, with all the papers that need to be sent to you. also, make sure that you get your finances straight since you have to pay some fees there, etc. once you get that NOA2, your case goes to the NVC which it is assigned a case number (starts with MNL), then from there is just a matter of paying the different fees and scheduling the interview. now, hoping that all goes well with her Medical and Interview so she can make it here before the baby!!!
