Hi, i am preparing AOS form for my wife. I have trouble on filing the I-864 Part 3 no. 9, do i need to list my wife and her child on this? or do i have to list them separately?

and for Part 5 Sponsor's household Size

21 a : 1

21 b : 1

21 c : 1

21 d : 1 (i have a girl)

21 e : 0

21 f : 0

21 g : 0

21 h : 3

17-09-2011 2nd checklist with different request

20-09-2011 sent out the checklist requested

28-09-2011 CC for my case

01-10-2011 Received P4 for interview date on November 22

05-10-2011 CC for my son's case

08-10-2011 received P4 for son's case

07-11-2011 Medical

09-11-2011 picked up the result, everything is good, thanks god!

22-11-2011 Visa APPROVED!

28-11-2011 Pick up the visa

Hi Icha,

I'm assuming you are also sponsoring your wife's child too?

If YES... than Part 3 / No.9 you should list ONLY HER child's information, NOT your wife, AND, only if you are planning for her child to immigrate at the same time (I'm assuming your trying to bring them both to the US at the same time (same trip)).

Your Wife's information should all be listed in Part 2 (REMEMBER: The address portion etc. is referring to her information in her country of residence. NOT your address in the US where she will be moving.

Regarding Part 5: Sponsor's Household Size

Most of it is fine BUT you need to make a couple corrections: (It should be as follows):

Part 5/ 21.a should be 02 (BECAUSE: Part 3/No. 8 = Your wife + No. 9a. = your wife's child..... Therefore, Part 3/No. 10 = 02

Corrections are in red:

21 a : 02 (The reasons as discussed above).

21 b : 1

21 c : 00 (Although you are married... do not count your wife here in this block. She is the principal you are sponsoring, so she's already accounted for in Number 21a. (NOTE: Part 5. 21. says: "DO NOT COUNT ANYONE TWICE")

21 d : 1 (i have a girl)

21 e : 0

21 f : 0

21 g : 0

21 h : 04 (For reasons I have explained above / i.e. You + Wife + Your Girl + Wife's Child = 04 people household size)

Hope this helps and all makes sense so you can understand everything. Please feel free to let me know if you're struggling with it.

d. If you have dependent children, enter the number here. [ 2 ]

e. If you have any other dependents, enter the number here. [ 0 ]

f. If you have sponsored any other persons on an I-864 or

I-864 EZ who are now lawful permanent residents, enter the number here. [ 0 ]

g. OPTIONAL: If you have siblings, parents, or adult children with the

same principal residence who are combining their income with yours by

submitting Form I-864A, enter the number here. [ 0 ]

Part 5. No. 21.c SHOULD BE "0". (See the reason I wrote in the previous post... same applies in your case).

Hi Bleauwolf, Thank so much for your help - I got that one now!

Just to check on one more thing - Should I use the I-864 or I-864EZ?

I think I qualify for the I-864EZ since all three of the following are true for me:

You filed a Form I-130 petition, for your relative

The there is only one applicant on the Form I-130 petition, and

All your qualifying income comes from a salary or pension and shows on one or more W-2 Forms that you receive

Any idea?

What about my wife's child I-864 form? should i write like this:

Part 2 (my wife's child information)

Part 3/no.9

I click on the i am sponsoring the following family members immigration etc

and i put my wife's name in the box.

Part 3/no. 10 : 2

Part 5 : will be the same with ur previous answer.
