i-864/864a General Question & #24 Question

I'm a USC, my wife is Chinese and we filed the I-130 via DCF in Beijing at the beginning of June. Everything's going well so far. We didn't front load the financial info, so we're getting it all ready now, as her P3 should show up soon. Here's what we're planning for the financial affidavits.

I don't make enough money so:

I will file an i-864

My mother will file an i-864 as a joint sponsor

My father will file an i-864a as a co-sponsor since my parents file joint taxes (I wanna play it on the safe side, since they file jointly, and have him file an i-864a, even though my mother makes enough)

So, the question is:

On the i-864 Question 24:

Line a. should be: My income

Line b. should be: My father's income?? What about my mother's income??

Is this the best course of action overall?

Your father doesn't need to file the i-864a if your mother makes enough. Just send your mother's W2's also since they filed jointly.

You will need to file 2 i-864, one from you and one for your mom......therefore one form would be about your income and the other form would be about your mom.

Your father doesn't need to file the i-864a if your mother makes enough. Just send your mother's W2's also since they filed jointly.

It does help, but I've read about people being denied because (in this case, my father) didn't file an i-864a. I know that they shouldn't have to, but I also know that the visa officers are extremely subjective and don't always interpret the rules they way they should. Maybe I could just send my father's W2s so that they can see the separation of income clearly (even though my mother's W2s will show that).

Everything depends on how many family members you parents support and how much do they make. If they are by themselves, then the number of family members in their family would be 3 and need 23,162 (125% of poverty level for 3). So the answer is it depends - if you provide more info, we can guide - sure you can also figure it out and hopefully the following details may help.

I say make 3 I-864s, not 2. GUZ IV can be difficult, but if they see the I-864a isn't needed, they will tell her about it on interview day (and that's a good thing)

Well if it makes you feel more comfortable and safe, then your dad can file the i-864a. It would probably be a good thing too and it doesn't hurt to send it. Atleast they will see that your wife has 3 sponsors and will not become a public charge.

You will fill out i-864 with just your info(income )

Your mom will fill out i-864 with her income(#23&24 and your dads info in 24b)

Your dad will fill out i-864a

Well, since we technically don't need my father's income, I don't think we need him to fill out an i-864, but since we would just be using him to add income, then the i-864a seems appropriate, I was mostly confused about how to fill out Question 24 in regards to who's income goes where.

The i-864a is the best bet. So your dad's income would go on your mom's form (24b) and the total income of your mom and dad on (24c) plus he will fill put the i-864a.

Ok, so my father's i-864a is "attached to" my mother's i-864, hence my dad's income info going on her i-864. That makes sense. Thanks. :)

I still don't understand how question 21c makes sense, but everyone says to put a '0' there - even though my wife is the person being sponsored in 21a (thus it seems she should be a '1' in 21c). I'm gonna put a '0' in 21c and hope for the best. :/

Ok. You mentioned that she is filing I-864, so her income from item 23 will be entered in Item 24 a. The income of your Dad is to be entered in Item 24 b (Name, Relationship & Curret Income (2011)). And Item 24 c will be the total of your parents current income. Your Dad need to file I-864A, if you check Item 24 d else no need.

Now if your mother is making enough to cover 3 members (23,162), then don't fill anything in Item 24 b, 24 d. The Item 24 c will be your mother's current income. Hope this helps.

These forms can be really complicated. If you read the i-864 instructions for filling out this part, it says "do not count anyone twice" so i guess 0 should work.

My mom makes enough to support 4 family members, but the issue is that my parents file their taxes jointly (I know this shouldn't be an issue, as my mother's W2's should solve that, but their are people who have been denied on these grounds) and it becomes tricky separating assets on a joint tax return, hence I think it's better to just throw an i-864a in for my dad to alleviate any concerns the visa officer might have.

Yeah, I just don't understand how they figured you can "not count anyone twice" if the sponsored immigrant is also the spouse of the sponsor. Go US Gov't!

It's still the clarity issue because of my parent's filing their taxes jointly. Regardless of the fact that my mom makes enough for both 3 and 4 people, will it hurt to have my dad's income included in 24b?

I know right!! You can definitely lose sleep over these forms :-) You're smart, throw it in...it doesn't hurt. Each case is different and so is each visa officer
